Moreover there were always one or two regular pupils who accompanied the jurisconsult, attended carefully to his words, and committed them assiduously to memory or writing. Cicero himself did this for the younger Scaevola, and thus laid the foundation of that clear grasp on the civil law which was so great a help to him in his more difficult speeches.
He spoke his first Oration in the Forum in the consulship of L. Crassus and Q. Scaevola, to whom it was personally adressed; and though he was then only nineteen years old, he descended from the Rostra with the hearty approbation not only of the audience in general, but of the two Consuls themselves, who were the most intelligent judges in the whole city.
The most resolute in this respect was Quintus Mucius Scaevola, like his father Publius -pontifex maximus- and in 659 consul, the foremost jurist and one of the most excellent men of his time.
The next year Q. Varius was condemned, and banished, by his own law: and I, that I might acquire a competent knowledge of the principles of jurisprudence, then attached myself to Q. Scaevola, the son of Publius, who, though he did not choose to undertake the charge of a pupil, yet by freely giving his advice to those who consulted him, he answered every purpose of instruction to such as took the trouble to apply to him.
Caius Valerius Laetorius was created decemvir for the performance of sacred rites, in the room of Quintus Mucius Scaevola, deceased. I should willingly have passed over in silence the reason of a flamen's being compelled to be inaugurated, had he not become a good, from having been a bad character.
Well, on this occasion, happening to mention this particular circumstance, Scaevola detailed to us a discourse of Laelius on friendship delivered to himself and Laelius's other son-in-law Galus Fannius, son of Marcus Fannius, a few days after the death of Africanus. The points of that discussion I committed to memory, and have arranged them in this book at my own discretion.
Reason does even a little more, and it is all she can do. She gives the best direction possible to the absurdity. Thus she directs those who must believe because they cannot know, to believe in the laws of their country, and conform their opinions and practice to those of their ancestors, to those of Coruncanius, of Scipio, of Scaevola not to those of Zeno, of Cleanthes, of Chrysippus.
When, after Marius had been driven from the city, Sulla asked the Senate to declare him by their vote a public enemy, Scaevola stood in a minority of one; and when Sulla urged him to give his vote in the affirmative, his reply was: "Although you show me the military guard with which you have surrounded the Senate-house, although you threaten me with death, yon will never induce me, for the little blood still in an old man's veins, to pronounce Marius who has been the preserver of the city and of Italy an enemy."
I would have cut off my own right hand, or burnt it to a cinder like Scaevola; sooner gone out to service played chambermaid on the boards, or the tragedy-queen of the commonest melodrama, far rather! It was all insult, injury, degradation, in whatever light I could view it, and every feeling in my nature was stung to exasperation.
Both statesmen and poets cultivated it, and gained it a legitimate place among the genuine philosophical creeds. Stoicism was far more congenial to the national character, and many great men professed it. Besides Laelius, who was a disciple of Diodes and Panactius, we have the names of Rutilius Rufus, Aelius Stilo, Balbus, and Scaevola.
