Most uneconomic, for they make closure the rule of industry, leading not to wealth, but to that awful waste of wealth which is made visible to every eye in our unemployed not hands alone, but land, machinery, and, most of all, hearts. Those who still practise these frontier morals are like criminals, who, according to the new science of penology, are simply reappearances of old types.
Healthy and capable persons in a decent society would be unlikely to turn out criminals. I do not see how we can escape the conclusion that the saner penology of the present has completely undermined the whole juristic basis of the next world. Human ethics and a supernatural ethics of an eschatological sort cannot be dovetailed together.

Then there are the laws regulating punishment for crime, laws for probation or parole, indeterminate sentences, etc., all based on the modern theory that reform, not retribution or even prevention, is the basis of penology. Such laws have been held constitutional, even when their result is to arbitrarily increase a man's sentence for crime on account of his past or subsequent conduct.

Many men of bad conduct may be excused on the plea that they are ignorant know no better; but this man was an intelligent student of penology, and knew exactly how wicked and wanton he was.
