In support of what has been said above, I might cite innumerable instances, as of Moses, Lycurgus, Solon, and other founders of kingdoms and commonwealths, who, from the full powers given them, were enabled to shape their laws to the public advantage; but passing over these examples, as of common notoriety, I take one, not indeed so famous, but which merits the attention of all who desire to frame wise laws.

If we imagine a confederacy of Highland chiefs even a century or two ago give them a nominal king consider their pride and their jealousy see them impatient of authority in one above them, yet despotic to those below quarrelling with each other united only by clanship, never by citizenship; and place them in a half-conquered country, surrounded by hostile neighbours and mutinous slaves we may then form, perhaps, some idea of the state of Sparta previous to the legislation of Lycurgus.

The Spartans had changed greatly since the days of Lycurgus. They no longer obeyed his wise laws, and, instead of being brave and frugal, they were greedy, lazy, and wicked. One of their kings was named Leonidas; but he was in no way like his great namesake, the king who had fallen at Thermopylæ.

Confucius himself belongs rather to the type of Lycurgus and Solon than to that of the great founders of religions. He was a practical statesman, concerned with the administration of the State; the virtues he sought to inculcate were not those of personal holiness, or designed to secure salvation in a future life, but rather those which lead to a peaceful and prosperous community here on earth.

Indeed, whosoever shall look at the sedition and misgovernment which befell these bordering nations to whom they were as near related in blood as situation, will find in them the best reason to admire the wisdom and foresight of Lycurgus.

At the time of Lycurgus the Spartans held only a small portion of Laconia: they were merely a garrison in the heart of an enemy's country. Their first object was to make themselves masters of Laconia, in which they finally succeeded after a severe struggle. They next turned their arms against the Messenians, Arcadians, and Argives.

Lycurgus took the oracle in writing, and sent it over to Sparta; and, having sacrificed the second time to Apollo, and taken leave of his friends and his son, he resolved that the Spartans should not be released from the oath they had taken, and that he would, of his own act, close his life where he was.

When Lycurgus undertook to make laws for Sparta, in what condition did he find this republic? On this point all historians agree. The people and the nobles were at war. The city was in a confused state, and divided by two parties, the party of the poor, and the party of the rich. Hardly escaped from the barbarism of the heroic ages, society was rapidly declining.

He was as careful to save his city from the infection of foreign bad habits, as men usually are to prevent the introduction of a pestilence. Hitherto I, for my part, see no sign of injustice or want of equity in the laws of Lycurgus, though some who admit them to be well contrived to make good soldiers, pronounce them defective in point of justice.
