But the Dred Scott decision announced that slaves were property which Congress could not exclude from the Territories, adding also the inevitable conclusion that what Congress could not do a Territorial Legislature could not.
The business interests of the East shuddered at the Lincoln parable. But Lincoln took occasion at Freeport to make Douglas even more unpopular in the South than he already was, by asking him if he did not support the Dred Scott decision; also if he still adhered to the popular sovereignty doctrine as a means of settling the slavery problem in the Territories.
I am opposed to that decision in a certain sense, but not in the sense which he puts on it. I say that in so far as it decided in favor of Dred Scott's master, and against Dred Scott and his family, I do not propose to disturb or resist the decision. I never have proposed to do any such thing.
This celebrated case arose in Missouri, where a negro named Dred Scott who had been taken by his master to States where slavery was prohibited by law, who had, with his master's consent, married and had children in the free States, and been brought back to Missouri sued for his freedom.
It linked the action of Border Ruffians, presidential aspirants, senates, courts, and cabinets into efficient coöperation; leading up, step by step, from the repeal of the Missouri Compromise, through the Nebraska bill, border conquest, the Dred Scott decision, the suppression of the submission clause in the Toombs bill, and the extraordinary manipulation and machinery of the Lecompton Constitution, towards the final overthrow of the doctrine that "all men are created equal," and the substitution of the dogma of property in man; towards the judicial construction that property rights in human beings are before and above constitutional sanction, and that slavery must find protection and perpetuity in States as well as in Territories.

In the case of Kansas they have sought by force of arms to assert the right of bringing slaves into a free territory, and in the Dred Scott case they obtained an extrajudicial opinion from the Supreme Court, which would have placed all the territories at their disposal. All this while the North has been resisting, feebly and ineffectually, this succession of Southern aggressions.
They decide in this case that Dred Scott is a Slave. Nobody resists that. Not only that, but they say to everybody else, that persons standing just as Dred Scott stands, are as he is. That is, they say that when a question comes up upon another person, it will be so decided again, unless the Court decides in another way unless the Court overrules its decision.
