On the north side was the Comitium, an open space for holding the Comitia Curiata and heavy lawsuits, and making speeches to the assembled people. During the kingly government the temples of Janus and Vesta and Saturn were erected, also the Curia Hostilia, a senate-house, the Senaculum, the Mamertine Prison, and the Tabernae or porticoes and shops inclosing the Forum.

Each curia was divided into ten families, or gentes. The assembly of the citizens was called the Comitia Curiata. The Comitia chose the King. The Senate was a council of elders representing in some way the gentes. The clan, or gens, was always of great consequence among the Romans. Its name was a part of the proper name of every citizen.

If it was thus put off into the next year, Domitius and Appius, not being any longer consuls, would have still greater difficulty. Corrupt as the arrangement was, it seems not to have come under any existing law, and both escaped punishment. Appius went as proconsul to Cilicia, in spite of the lex curiata not being passed, but Domitius Ahenobarbus seems not to have had a province.

"The second essay of the elders and youth being marched out of their tribes, the lords high sheriffs and lieutenants shall have the remaining part of the annual bands both of elders and youth in readiness, which, if the beacons be fired, shall march to the rendezvous to be in that case appointed by the Parliament or the Dictator: And the beacons being fired, the curiata comitia, or parochial congregations, shall elect a fourth both of elders and youth to be immediately upon the guard of the tribes, and dividing themselves as aforesaid, to march also in their divisions according to orders, which method in case of extremity shall proceed to the election of a third, or the levy of a second, or of the last man in the nation, by the power of the lords high sheriffs, to the end that the commonwealth in her utmost pressure may show her trust that God in his justice will remember mercy, by humbling herself, and yet preserving her courage, discipline, and constancy, even to the last drop of her blood and the utmost farthing.

Numa, although the people had proclaimed him king in their Comitia Curiata, did nevertheless himself pass a Lex Curiata respecting his own authority; and observing that the institutions of Romulus had too much excited the military propensities of the people, he judged it expedient to recall them from this habit of warfare by other employments.

This privilege was conceded to the plebeians by the Valerian law, but must have been possessed by the patricians from the earliest times; for Horatius, when condemned for the murder of his sister, in the reign of Tullus Hostilius, escaped by appealing to the comitia curiata.

The House, I have explained already, was a fictitious extension of the family, consisting of all Roman Patrician citizens who bore the same name, and who, on the ground of bearing the same name, were supposed to be descended from a common ancestor. Now the Patrician Assembly called the Comitia Curiata was a Legislature in which Gentes or Houses were exclusively represented.

On one side were the elevated seats or suggestus, a sort of pulpits from which magistrates and orators addressed the people, usually called Rostra, because adorned with the beaks of ships which had been taken in a sea-fight from the inhabitants of Antium. Near by was the part of the Forum called the Comitium, where were held the assemblies of the people called Comitia Curiata.

He accused him of lèse majesté, and gave the names of his witnesses without Gabinius answering a word. That is all the public news. At home all is well: your house itself is being proceeded with by the contractors with fair expedition. There was some doubt as to the question whether such allotment did not give imperium even without a lex curiata.

Not so, however, the Comitia Curiata or Comitia Tributa. They were fettered on this point by the sacredness with which the person of a Roman citizen, inside the walls of the city, was invested by religion and law; and, with respect to the last of them, the Comitia Tributa, we know for certain that it became a fixed principle that the Assembly of the Tribes could at most impose a fine.
