Within six years after Confederation the whole northern half of the continent had been absorbed by Canada. The four original provinces comprised only one-tenth of the area of the present Dominion, some 377,000 square miles as against 3,730,000 today. The most easterly of the provinces, little Prince Edward Island, had drawn back in 1865, content in isolation.
In 1820 they produced a third; in 1830, a half; and by 1860, three-quarters of the cotton raised. At the same time, the population of the Alabama-Mississippi territory was: 200,000 in 1810. 445,000 in 1820. 965,000 in 1830. 1,377,000 in 1840. Thus thirty years saw an increase of nearly seven-fold in the population of this region. Meanwhile, slavery had become the issue of the day.
It concerns paragraph 377 of the report, a paragraph building up to a quotable phrase that has become well known in New Zealand and abroad: 377. No judicial officer ever wishes to be compelled to say that he has listened to evidence which is false.
In 1901 the men of the life-saving corps were called to give aid to 377 wrecked ships. Of property in jeopardy valued at $7,354,000, they saved $6,405,035 worth. Of 93,792 human beings in peril of death in the waters, all save 979 were saved.
There are imputations of collective bad faith which had started from a high place in the company and all this was likely to receive the widest publicity, further, the findings in paragraph 377 amounted to public and official disclosures of alleged criminal conduct and led to investigation by the police to determine whether charges should be laid.
I find this statement corroborated, as far as regards one place, by Mackenzie in his "Travels" page 377, and in another place by some MS. notes kindly lent me by Dr. Holland. The coast is deeply indented by creeks, at the head of which the land is generally low.
So we conclude that in making the findings or allegations stated in paragraph 377 of the report the Commission acted in excess of jurisdiction and contrary to natural justice. As previously mentioned, the conspiracy postulated in paragraph 377 is evidently intended to include as participants the chief executive of the airline, the executive pilots and members of the navigation section.

It must always be sensible for any Commission of Inquiry or other tribunal to keep those words in mind. We are satisfied that the findings contained in each of paragraphs 348 and 377 are collateral assessments of conduct made outside of and were not needed to answer any part of the terms of reference.
