Owing partly to improved methods of selection, partly no doubt to chance, even more mutants were found this year than in the former. Out of some 8,000 seedlings I counted 377 deviating ones, or nearly 5%, which is a high proportion. Most of them were oblonga and lata, the same types that had constituted the majority in the former year.
Whitelock, 583,597, 599. Burnet, i. 58-61. Baillie, ii. 377, 381. The moderator meekly but firmly replied, that they formed a spiritual court, established by God, recognized by law, and supported by the solemn league and covenant. But this was a language which the soldier did not, or would not, understand.
The estimated receipts for the year ending June 30, 1890, are $377,000,000, and the estimated ordinary expenditures for the same time are $275,767,488.34, showing a surplus of $101,232,511.66. The foregoing statements of surplus do not take into account the sum necessary to be expended to meet the requirements of the sinking-fund act, amounting to more than $47,000,000 annually.
Here, for instance, are the returns for 1870, of men of military age in some portions of the country: Arizona 5,157 Colorado 15,166 Dakota 5,301 Idaho 9,431 Montana 12,418 Nebraska 35,677 Nevada 24,762 New Hampshire 60,684 Oregon 23,959 Rhode Island 44,377 Vermont 62,450 West Virginia 6,832
To the balance of $32,860,030.05 of receipts over expenditures for the year 1894 should be added the estimated surplus at the beginning of the year, $20,992,377.03, and from this aggregate there must be deducted, as stated by the Secretary, about $44,000,000 of estimated unexpended appropriations.
The present case is in many ways unique and, if the findings in paragraph 377 were made without jurisdiction or contrary to natural justice, it affords a striking instance of how contrary to the public interest it would be if the Courts were not prepared to protect the right to reputation.

That cannot possibly, even on Hume's recommendation, be accepted as metaphysical truth, which flatly contradicts common sense, nor can there be any unbecoming self-confidence in seeking, even though Hume pronounce the search hopeless, for metaphysical truth, with which common sense may be reconciled. By James Mill. Mill's 'Logic. 5th Edition. Vol. i. p. 377.
Athanasius refused to touch it at Sardica in 343, refused again at Alexandria in 362, and to the end of his life refused to admit that it was in any way defective. Basil himself as late as 377 declined even to consider some additions to the incarnation proposed to him by Epiphanius of Salamis.
In relation to paragraph 377 the allegation of excess of jurisdiction turns accordingly on whether the findings are reasonably incidental to an inquiry into the causes and circumstances of the crash. It is difficult to find reasons why the Court should refuse to entertain that question.
