The wild worship of the Cappadocian Ma, or, as the Romans called her, Bellona, to whom the priests in their festal processions shed their own blood as a sacrifice, and the gloomy Egyptian worships began to make their appearance; the former Cappadocian goddess appeared in a dream to Sulla, and of the later Roman communities of Isis and Osiris the oldest traced their origin to the Sullan period.
De Leg. iii. 4, 10 and more clearly by the -plebiscitum de Thermensibus-, which however in the opening formula also designates itself as issued -de senatus sententia-. That the consuls on the other hand could under the Sullan arrangements submit proposals to the people without a previous resolution of the senate, is shown not only by the silence of the authorities, but also by the course of the revolutions of 667 and 676, whose leaders for this very reason were not tribunes but consuls.
This rude justice would suffice in a small city and a simple social system; but it would be totally inadequate to protect life and property in a huge population, such as that of the Rome of the last century B.C. Since the time of Sulla there had indeed been courts for the trial of crimes of violence, and at all times the consuls with their staff of assistants had been charged with the peace of the city; but we may well ask whether the poor Roman of Cicero's day could really benefit either by the consular imperium or the action of the Sullan courts.
On the Roman oligarchy of this period no judgment can be passed save one of inexorable and remorseless condemnation; and, like everything, else connected with it, the Sullan constitution is completely involved in that condemnation.
With the same view of creating a permanent Sullan party in Italy, and at the same time to fulfil his pledges to the soldiers, he allotted to them all public lands in Italy hitherto undistributed, and all confiscated land not otherwise disposed of. In this way he punished and rewarded at a stroke. No fewer than 120,000 allotments were made and twenty-three legions provided for.
He tells us of those who have wealth and yet will not pay their debts; of those who are in debt and look to a revolution to absolve them; of the veterans of the Sullan army, settled in colonies such as Faesulae, who had rushed into debt in order to live luxurious lives; of old debtors of the city, getting deeper and deeper into the quagmire, who joined the conspiracy as a last desperate venture.
On occasion of the Sullan proscriptions a forgery in the lists had been proved against him, for which reason Sulla made no more use of him thenceforward in the affairs of state: he did not refuse to accept an inheritance, because the testamentary document which contained his name was notoriously forged; he made no objection, when his bailiffs by force or by fraud dislodged the petty holders from lands which adjoined his own.
During the siege of Pompeii the commander of the Sullan besieging corps, the consular Aulus Postumius Albinus, was put to death with stones and bludgeons by his soldiers, who believed themselves betrayed by their general to the enemy; and Sulla the commander-in-chief contented himself with exhorting the troops to efface the memory of that occurrence by their brave conduct in presence of the enemy.
It adopted a hazardous course, when it sacrificed the outworks of its dominion in the Greek settlements and kingdoms on the Euphrates and Tigris; but, when it allowed the Asiatics to establish themselves on the Mediterranean which was the political basis of its empire, this was not a proof of love of peace, but a confession that the oligarchy had been rendered by the Sullan restoration more oligarchical doubtless, but neither wiser nor more energetic, and it was for Rome's place as a power in the world the beginning of the end.
If we combine with such considerations the fact, that Sulla allowed the principal foundations of the Gracchan constitution to stand and disturbed neither the equestrian courts nor the largesses of grain, we shall find warrant for the opinion that the Sullan arrangement of 666 substantially adhered to the status quo subsisting since the fall of Gaius Gracchus; he merely, on the one hand, altered as the times required the traditional rules that primarily threatened danger to the existing government, and, on the other hand, sought to remedy according to his power the existing social evils, so far as either could be done without touching ills that lay deeper.
