Not unlikely, however, General Escobedo would have done what he now did, which was to advance on Querétaro and invest it with his army. Thus the empire of Maximilian was limited to this one town, where it was besieged by an army of Mexican patriots, while, with the exception of a few cities, the whole country outside was free from imperial rule.

His dream and ambition was to establish a Mexican republic, and the present constitution, which bears date of 1857, was virtually his gift to the people. He has been very properly called the prophet and architect of the republic. In the cemetery of San Fernando were also seen the tombs of Mejia and Miramon, the two generals who, together with Maximilian, were shot at Queretaro.

Meanwhile the Mexican government had departed in the person of Santa Anna, and it looked doubtful for a time whether the United States commissioner, Mr. Trist, would find anybody to negotiate with. A temporary government, however, was soon established at Queretaro, and Trist began negotiations for a conclusion of the war.
