It is not a congress of delegates or ministers who are obliged to act under instructions, to report their acts to their respective sovereigns for approval or rejection; it is itself sovereign, and may do whatever the people themselves can do. There is no necessity for it to appeal to a plebiscitum to complete its acts.

One might almost say that the traitor is struck treacherously. In this case there is a bad man who feels himself in the grasp of Destiny, and who does not know what it is doing to him. He was at the summit of his power, the blind master of an idiot world. He had wished for a plebiscitum, he had had one. He had at his feet this very William. It was at this moment that his crime suddenly seized him.

De Leg. iii. 4, 10 and more clearly by the -plebiscitum de Thermensibus-, which however in the opening formula also designates itself as issued -de senatus sententia-. That the consuls on the other hand could under the Sullan arrangements submit proposals to the people without a previous resolution of the senate, is shown not only by the silence of the authorities, but also by the course of the revolutions of 667 and 676, whose leaders for this very reason were not tribunes but consuls.

Probably if the people of New England could have a plebiscitum on their weather, they would vote against it, especially against winter. Almost no one speaks well of winter. And this suggests the idea that most people here were either born in the wrong place, or do not know what is best for them. I doubt if these grumblers would be any better satisfied, or would turn out as well, in the tropics.

Having accepted a sham plebiscitum, he annexed, by a formal decree of 18th March, the Grand Duchy of Tuscany, the Duchies of Parma and Modena, and that portion of the Papal States known as the Legations, to his ancient kingdom of Sardinia and Piedmont.

Great disorders followed, but the commons prevailed, and the Senate adopted the plebiscitum, and proposed it to the Comitia Curiata, and it became a law. This step raised the authority of the tribunes, and added to Roman liberties. He cultivated a little farm of four jugera with his own hands, and lived with great simplicity.

"The artifice of Louis Bonaparte, imitator of his uncle in this as in everything," said Michel de Bourges, "had been to throw out in advance an appeal to the People, a vote to be taken, a plebiscitum, in short, to create a Government in appearance at the very moment when he overturned one.

If, however, the nation at large had known what was going on behind the scenes, both in diplomatic and in military spheres, the result of the Plebiscitum would probably have been very different.

In the case of the states and provinces except Lombardy, ceded to France by Austria, and sold to the Sardinian king annexed to Piedmont to form the new kingdom of Italy, the plebiscitum was invalid, because implying the right of the people to rebel against the legal authority, and to break the unity and individuality of the state of which they form an integral part.
