The theory is still that of the Roman lawyers, for in the phantasmagoria with which the Natural Condition is peopled, every feature and characteristic eludes the mind except the simplicity and harmony which possessed such charms for the jurisconsult; but the theory is, as it were, turned upside down.

As to the conveyance of witches through crevices, keyholes, chimneys, and the like, Herr Walburger discusses the question with such comical gravity that we must give his argument in the undiminished splendor of its jurisconsult latinity. The first sentence is worthy of Magister Bartholomaeus Kuckuk.

A fragment of the wonderful system which they built up survives in the Pandects of Justinian, and supplies evidence that their works took the form of treatises on all parts of Roman Law, but chiefly that of commentaries on the Edict. And there were many meetings of the Leaguers in Paris, many belligerent speeches by the cardinal legate, proclaiming war to the knife rather than that the name of Henry the heretic should ever be heard of again as candidate for the throne, various propositions spasmodically made in full assembly by Feria, Ybarra, Tassis, the jurisconsult Mendoza, and other Spanish agents in favour of the Infanta as queen of France, with Archduke Ernest or the Duke of Guise, or any other eligible prince, for her husband.

The commissioners named by Innocent VIII. to prosecute the witch-trials in Germany, were Jacob Sprenger, so notorious for his work on demonology, entitled the "Malleus Maleficarum," or "Hammer to knock down Witches," Henry Institor a learned jurisconsult, and the Bishop of Strasburgh.
