By a law passed in 1825, five hundred statutes dating from the time of Edward I. were repealed, and the essence of the law given in a volume of moderate size. Finally, the removal of prohibitions was undermining the smugglers. The measures upon which Huskisson justly prided himself might have been dictated by the Political Economy Club itself.
That the Secretary of the Treasury is hereby further authorized to prescribe such rules and regulations, not inconsistent with the laws of the United States, as he may deem necessary to carry into effect the provisions of this Act, and to prevent the illegal re- importation of any goods, wares, or merchandize which shall have been exported as herein provided; and that all Acts or parts of Acts inconsistent with the provisions of this Act, be, and the same are hereby repealed."
Unhappily, the new Ministry was only permitted to do good by halves. The same session that repealed the Stamp Act promulgated the Declaratory Act, asserting the full power of the King, on the advice of Parliament, to make laws binding the American colonies in all cases whatsoever.
Both dinners were well attended, and at both the repeal of the Stamp Act was celebrated with patriotic enthusiasm, the main difference being that whereas the Sons of Liberty drank a toast to Mr. MacDougall and to "a continuance of the non-importation agreement until the revenue acts are repealed," the Friends of Liberty and Trade ignored Mr.
We are now in 1737, and the Test Act was not repealed until 1828. Historians are sometimes reproached for paying too much attention to palace squabbles; yet a palace squabble becomes a matter of some importance if it can postpone an act of national justice for by far the greater part of a century.
Howe, for his defense, in appeal, raised the natural objection that it was unfair and improper to try Rosenzweig in two cases at once. Consequently, he got a new trial, in which he was acquitted, because the old law under which he had been previously convicted had been repealed. Here was a manifest miscarriage of justice effected by a wise change in the laws.
They called for the repeal of the Stamp Act, and declared against the importation of English goods until the repeal should be granted. William Pitt, in the House of Commons, eulogized the spirit of the colonies. The Stamp Act was repealed. The discussions which it had provoked in America had awakened the whole people, and made them watchful against this sort of aggression.
With little opposition these conditions were fulfilled, though there was a strong feeling against the repudiation of the debt, much discussion as to whether the ordinance of secession should be "repealed" or declared "now and always null and void," and some quibbling as to whether slavery was being destroyed by state action or had already been destroyed by war.
The compromise has been since annulled, on the ground, I believe, that Congress had not constitutionally the power to declare that any soil should be free, or that any should be slave soil. That is a question to be decided by the States themselves, as each individual State may please. So the compromise was repealed. But slavery has not on that account advanced.
Chichester started and, uttering an exclamation, turned savagely; then Barnabas struggled to his knees, and pinning his wrist with one hand, twisted the pistol from his grasp with the other and, as Mr. Chichester sprang to his feet, faced him, still upon his knees, but with levelled weapon. "Don't shoot!" cried a voice. "Shoot?" repealed Barnabas, and got unsteadily upon his legs.
