In the first it must be observed, that, according to the new Constitution, the higher parts of judicature, in either of its lines, are not in the king. The king of France is not the fountain of justice. The judges, neither the original nor the appellate, are of his nomination. He neither proposes the candidates nor has a negative on the choice. He is not even the public prosecutor.

In one celebrated case it lasted four years and over seven hundred witnesses were kept in jail during that time. The prosecutor admitted that only twenty persons deserved punishment, yet there were seventy-three who died from suicide or the effects of confinement. Louder and louder grew the clamor of the masses and the threats against the imperial autocrat.

The said company, and none else, are to trade within the said limits; and, if any other persons shall trade to the South Seas, they shall forfeit the ship and goods, and double value, one-fourth part to the crown, and another fourth part to the prosecutor, and the other two-fourths to the use of the company.

Somewhat later, in the visions of Zechariah, angels play a great part; they are sometimes spoken of as "men," sometimes as mal'akh, and the Mal'akh Yahweh seems to hold a certain primacy among them. Similarly in Job the bne Elohim, sons of God, appear as attendants of God, and amongst them Satan, still in his rôle of public prosecutor, the defendant being Job.

My whole spirit was in arms. I answered with promptness and bitterness, for I felt the cruelty of such an attack upon a novice in my situation. When he muttered something about men's cruelty and women's helplessness, the president tried to help him by asking him to keep closer to the facts of the case. When he had finished the public prosecutor got up to reply.

In colonial Massachusetts William Stoughton held the offices of military commander, lieutenant governor, and chief justice at the same time. Because of the frequent and prolonged absences of the titular governor he was often the acting governor. As an inevitable consequence, when sitting as a judge he was more a zealous prosecutor than an impartial judge.

Bianchon served Lousteau well by making fun of the Public Prosecutor, of Monsieur Gravier, and of Gatien; there was a tone of such genuine contempt in his remarks, that Madame de la Baudraye dared not take the part of her adorers. "I perfectly understand the position you have maintained," said the doctor as they crossed the Loire.

That through the procurement of the gentleman here styled private prosecutor, who is a member of the Senate, a special session of this court was appointed for the trial of these offenders. That the ordinary movements of the wheels of justice were too slow for the purposes devised. But does not everybody see and know, that it was matter of absolute necessity to have a special session of the court?

The Constitution makes him sole judge in the premises, but the statute takes away his jurisdiction, transfers it to the Senate, and leaves him nothing but the odious and sometimes impracticable duty of becoming a prosecutor.
