It appears that R. R. Smith was appointed sheriff of Otsego on the 17th of February, 1791, and afterwards entered upon the execution of his office: that no other person was in the execution of or claimed the office after the date of his appointment, and before the time when he received and delivered the votes of the county to his deputy; that during that interval R. R. Smith was sheriff, or the county was without a sheriff; that R. R. Smith, during the election, and when he received and delivered the votes to his deputy, continued in the actual exercise of the shrievalty, and that under colour of a regular appointment.
Distressed, perplexed, half sick with fear for her, I plodded on behind the Mohican, striving to drive from me the sombre thoughts assailing me, trying to reassure myself with the knowledge that she was safe at Otsego with her new friends, and that very shortly now she would be still safer in Albany, and under the shrewd and kindly eye of Mr. Hake.
Nor were the characters of the principal personages out of harmony with the atmosphere that envelopes the scenes described. Though he has hurried as far away as possible from the din of the settlements, he is no longer querulous and irritable as in his old age in the Otsego hills. He has learned to recognize the inevitable. While he does not cease to regret, he has ceased to denounce.
"Well, there were and still are some few scalping parties hanging around Otsego. I myself see no real reason why the ladies should not pay us a visit here, have their frolic, and later return with the heavier artillery down the river to Easton. Or, if they choose, they shall await our return from Catharines-town." "And if we do not return? Have you thought of that, Boyd?"

This brought the travellers to a Dutch inn on the Mohawk, where the captain had often made his halts, and whither he had from time to time, sent his advanced parties in the course of the winter and spring. Here a jumper was found prepared to receive Mrs. Willoughby; and the horse being led by the captain himself, a passage through the forest was effected as far as the head of the Otsego.
"II. Because, if the committee were by law authorized to examine and determine the legality and extent of the sheriff's authority and commission, we are of opinion that Richard R. Smith, at the time he received and transmitted the ballots, was the lawful sheriff of Otsego.
When put up and adjusted, a rehearsal of country dances, reels, and more serious music came floating through the broad door and ample windows of Otsego Hall into Master Cory's domain, the Academy, which stood in the adjoining street.
They will enable you to form a competent judgment of the law question, and of the fairness of the Otsego return. I do not see how any unbiased man can doubt, but still I do not pretend to control the opinion of others, much less to take offence at any man for differing from me.
Be that as it may, the author was brought an infant into this valley, and all his first impressions were here obtained. He has inhabited it ever since, at intervals; and he thinks he can answer for the faithfulness of the picture he has drawn. Otsego has now become one of the most populous districts of New York.
