The majority which acquitted Opimius practically decided that Gracchus and his adherents had been rendered outlaws by their deeds.
Opimius had been impeached after his year of office, but acquitted, which the senate might claim as a confirmation of the right, in spite of the lex of Gaius Gracchus, which confirmed the right of provocatio in all cases.
At daybreak the consul Opimius sent a small force of armed men to the Capitol, evidently for the purpose of preventing the point of vantage being seized by the hostile democrats, and then he issued notices for a meeting of the senate. For the present he remained in the temple of Castor and Pollux to watch events.
The activity of the pursuers had been stimulated by greed, for Opimius had put a price upon the heads of both the leaders of the faction on the Aventine. The bearers of these trophies of victory were to receive their weight in gold.
The greatest part of the assembly were inclinable to accept of the proposals; but Opimius said, that it did not become them to send messengers and capitulate with the senate, but to surrender at discretion to the laws, like loyal citizens, and endeavor to merit their pardon by submission. He commanded the youth not to return, unless they would comply with these conditions.
