Here we was plannin' to go to Hannibal in about a week, when it was clear out of the question, for it was gettin' close to court time, and we was subpoened, Mitch and me, to testify against Doc Lyon. It was clear crazy to think of goin' to Hannibal and gettin' back in time. And I'd made up my mind to stick it out we couldn't run away for good.

There had been a great number of trials similar in character to the one we have already noticed; and though, in numerous instances, those who were notorious for their open and flagrant violation of the law escaped, because of the questionable evidence given by themselves and the wretched creatures who had been subpoened as witnesses, yet a great many were convicted and fined.

"I'll be blowed! but it would be as good as a circus, wouldn't it though?" observed Ginsling. "I wonder who would act as Her Majesty's representative, to vindicate the honor of outraged justice, if our sheriff happened to be the principal in a case of aggravated assault, and our judge had to be subpoened as a witness for the Crown!"

"Then it's true, is it, the cousin business?" says I. "Certainly it is, Torchy," says he. "Why not?" "Oh, nothin'," says I. "I wouldn't have thought it, though." "It isn't at all necessary," says Mr. Robert. "Bring him in at once." "I guess I can spare him," says I. Then I goes back and taps Cousin Clifford on the shoulder. "Cliffy," says I, "you're subpoened.

A surgeon who happened to have been subpoened upon the current trial, opened a vein, but the blood refused to flow; and a barrister, stripping himself of his gown, threw it over the body as a pall. No one dared enquire the origin of what he saw, until the judge arriving, demanded: "Who has done this?"

It is very curious that it was never communicated to the prisoners that I was in attendance to give evidence on their behalf; but when they saw me in court, they actually thought that I was subpoened as an evidence for the Crown against them. Lord Sidmouth now brought in a Bill for the further suspension of the Habeas-Corpus Act.

I sent a second message, by another person; but, as no notice was taken of it, I sent a third person, on the 8th, to say that I was in town, and unless it was intended to hang the prisoners, I expected that I should be subpoened, and that I was come to town on purpose to give my evidence. In fact, this third message rather conveyed a demand than a request, and I was next morning subpoened.

Those who had a little property, had sold their little all, even to their beds, as had also their relations, to raise money enough to pay for the expenses, of the witnesses, who had been subpoened on their behalf; but the whole did not amount to enough to include the fees of counsel.
