Anybody could see that discipline would go to pieces if the word of a jailer did not prevail over that of a prisoner, the word of a loyal and tried subordinate over that of a traitor and conspirator, an avowed sympathizer with the enemy. Presently the presiding officer inquired if the prisoner was aware that he had incurred the death-penalty.
In 1831, Sir Robert Peel took up the gauntlet against capital punishment, and endeavored to induce Parliament to abolish the death-penalty for forgery; the House of Commons voted its abolition, but the Lords restored the clauses retaining the penalty.
One thousand bankers signed a petition praying that the vote of the Commons might be sustained, but in vain; still, in deference to public opinion, after this the death-penalty was not inflicted upon a forger. Nevertheless, there remained plenty of food for the gallows.
With the dying flames her own vitality subsided, and she was dead before the ash-piles were cool. I say it seriously when I say that these are facts of which there is authentic proof. If the woman had recovered, she would have fared badly, even at that late period, had she been in Salem; but the death-penalty has never been hastily inflicted in Portsmouth.
I would, in all sincerity, suggest that humane and well-meaning men, who exert themselves for the remission of the death-penalty as a mercy, would rather implore that the doors of solitary and silent captivity should be remitted to the more merciful doom of an immediate relief from suffering by immediate execution the opportunity of an immediate appeal from man's cruelty to God's justice.
This class of waste must be distinguished from the wanton waste committed by army-stragglers, which is wrong, and can be punished by the death-penalty if proper testimony can be produced. Yours, etc., W. T. SHERMAN, Major-General commanding.
And often he narrated many passages in his own individual career, which were almost incredible, from the consideration that few men could have plunged into such infamous vices, and clung to them so long, without paying the death-penalty.

During the interval between their conviction and the day appointed for their execution, I had occasion to see them frequently, and was strongly impressed with the idea that they had sinned in ignorance of the magnitude of their offence, and that a commutation of the death-penalty would be of more benefit than injury to our cause.
For the fault lies not only in the fundamental perversity of all Roman Law. It lies also in the local administration of that law, which is inefficient and marked by that elaborate brutality characteristic of all "philosophic" and tender-hearted nations. They will never endorse that saying of Stendhal's: "In Italy, with the exception of Milan, the death-penalty is the preface of all civilization."
