With the Empire the Civil Code was completed, which I take to be the greatest effort at codification of modern times. Certainly it has endured until now. Governments have changed.

The antipathy to legal codification, which, until recent years, was a characteristic both of the English and American bar, and still prevails, though with diminishing force, has given, and necessarily given, great force to judicial precedents. It is mainly through them that with us unwritten law passes into written law. Precedent is a fruit of reason ripened by time.

To make a code you require a sovereign strong enough to dominate the lawyers, not a system in which lawyers are an essential part of a small governing class. Codification, in short, means centralisation in one department. Blindness to similar results elsewhere was a characteristic of the Utilitarian thinkers.

A reform of the calendar, which served the West till 1582, and serves Russia still; a recasting of the whole provincial administration; a codification of Roman law; a census of the Empire; a uniform gold coinage; a public library; a metropolitan police; building regulations; sanitary regulations; an alteration of the course of the Tiber, which would have drained the marshes all these grand projects, and more, some carried to completion, some only sketched out, teemed from the active brain of the great organizer, in the brief moments he could spare from military cares in these last months of his life a devouring activity, an all-embracing capacity, such as perhaps never shone forth in man before or since.

Such a combination is ugly, and people do not stop to think whether the baseness would be more or less if the ritual piety were absent instead of present. But it is the fact that on the whole the Jewish codification of religion did not produce the evil results possible or even likely to accrue.

But the Roman legal development had an essential advantage over ours in this, that the denationalized legislation appeared not, as with us, prematurely and by artificial birth, but at the right time and agreeably to nature.
