Now, it must not be withheld, for it would be too uncandid, that identical passages are found in the Annals ascribed to Tacitus and the Sacred History of Sulpicius Severus. In order that the reader may see the identity of the passages, we place them in juxtaposition, italicising the words that are found in both works:
This being accomplished, Sulpicius, who had now gained a victory, got the command conferred on Marius by the votes of the, assembly, and Marius, who was prepared to set out, sent two tribunes to receive the army of Sulla. But Sulla encouraging his soldiers, who were thirty-five thousand men well armed, led them to Rome. The soldiers fell on the tribunes whom Marius had sent, and murdered them.
The curule aediles, also, Caius Valerius Flaccus, who was flamen of Jupiter, and Caius Cornelius Cethegus, celebrated the Roman games with great magnificence. Servius and Caius Sulpicius Galba, pontiffs, died this year; in their room were substituted Marcus Aemilius Lepidus and Cneius Cornelius Scipio, as pontiffs.
After this speech of Sulpicius, being sent to give their votes, they declared for the war as he had proposed. On which, in pursuance of a decree of the senate, a supplication for three days was proclaimed by the consuls; and prayers were offered to the gods at all the shrines, that the war which the people had ordered against Philip might turn out well and happily.
What you have said on this occasion I consider as an absolute Irony: but I shall not inform you why I think so, lest you should imagine I design to flatter you. I shall therefore pass over the many fine encomiums you have bestowed upon these; and what you have said of Cotta and Sulpicius, and but very lately of your pupil Caelius.
Although Varus complained that his honour was insulted by Juba, yet he dare not oppose him: Juba rode on horseback into the town, attended by several senators, amongst whom were Servius Sulpicius and Licinius Damasippus, and in a few days arranged and ordered what he would have done in Utica, and in a few days more returned to his own kingdom, with all his forces.
The agreement being confirmed by oath on both sides, and the gold brought forth, the Gauls used false dealing in the weights, secretly at first, but afterwards openly pulled back and disturbed the balance; at which the Romans indignantly complaining, Brennus in a scoffing and insulting manner pulled off his sword and belt, and threw them both into the scales; and when Sulpicius asked what that meant, "What should it mean," says he, "but woe to the conquered?" which afterwards became a proverbial saying.
Caius Aurunculeius was appointed to command, in Sardinia, the same legions with which Publius Manlius Vulso had occupied that province. Publius Sulpicius was continued in command for the year, with orders to hold Macedonia with the same legion and fleet. Orders were given to send thirty quinqueremes from Sicily to Tarentum, to the consul Fabius.
The further prerogative of the tribune to have dealings with the people at pleasure, partly for the purpose of bringing up accusations and especially of calling former magistrates to account at the bar of the people, partly for the purpose of submitting laws to the vote, had been the lever by which the Gracchi, Saturninus, and Sulpicius had revolutionized the state; it was not abolished, but its exercise was probably made dependent on a permission to be previously requested from the senate.
The law proposed by Sulpicius and thereafter by Cinna himself, which promised to the new burgesses and the freedmen equality of suffrage with the old burgesses, was naturally revived; and it was formally confirmed by a decree of the senate as valid in law . Censors were nominated for the purpose of distributing all the Italians, in accordance with it, into the thirty-five burgess-districts by a singular conjuncture, in consequence of a want of qualified candidates for the censorship the same Philippus, who when consul in 663 had chiefly occasioned the miscarriage of the plan of Drusus for bestowing the franchise on the Italians, was now selected as censor to inscribe them in the burgess-rolls.
