I rely still more upon the special peripatetic inspectors and investigators who will be appointed under the Act by the Board of Trade, who will have to conduct prosecutions under the Act, and who will devote all their time to the purposes of the Act.
It was testified that in Box Elder County subscription lists had been circulated to collect money for the fines, but that the fines were never paid, though the subscriptions had been collected. All the prosecutions had been dropped, at last.
It is startling to compare the percentage of convictions to prosecutions, for the same class of offences, in the regular criminal courts during the French Revolution, with the percentage in the Revolutionary Tribunal. And once a stable social equilibrium is reached, all men tend to support judicial courts, if judicial courts exist, from an instinct of self-preservation.
The ferment in the nation was wrought up to a considerable height; but there was at that time no reason to expect that it could influence the proceedings in Parliament in favour of those who should be accused. Left to its own movement, it was much more proper to quicken than slacken the prosecutions; and who was there to guide its motions?
There is abundant reason for believing that he was the original instigator of the Gourlay prosecutions. They were at all events carried on by his satellites, and fostered by his fullest concurrence and approval. Their object was to drive Mr. Gourlay out of the country, and to this end it would appear that the Compact were prepared to go whatever lengths the necessities of the case might require.
Such was the political and public administration of the Province of Massachusetts, during the Summer of 1692, under which the Witchcraft prosecutions were carried on. It was conducted by men whom the Mathers had brought into office, and who were wholly in their counsels.
"The farmer and the mechanic alike," went on the report, "have been invited to make loans and have fallen victims to the avarice of the banker. The result has been the banishment of metallic currency, the loss of commercial confidence, fictitious capital, increase of civil prosecutions and multiplication of crimes."
It is true that, after the family had become relieved of its "sad circumstances from the invisible world," Mr. Baily took one of the children to his house, in Watertown; but that is no indication of his having given such advice. The only facts known of him, in connection with Witchcraft prosecutions, look in the opposite direction.
These prosecutions were conducted with unusual acrimony by Sir James Scarlet, the Attorney-General; and the Duke of Wellington came in for a very considerable share of public censure for having authorised such prosecutions.
By similar means that is, through frauds, forgeries, and perjuries, and by shameless briberies the laws relating to the proper conduct of the public service in general and to the due administration of the Post-Office Department have been notoriously violated, and many indictments have been found, and the consequent prosecutions are in course of hearing or on the eve thereof.
