Its Article 18 revived Article 1 of the 1854 Reciprocity Treaty, except that Canadians could now go so far south as the 39th parallel, and that two years' notice must precede abrogation. Article 21 ordained between the two countries free trade in fish-oil and in all salt-water fish.
This done I proposed, and the others approved my proposition, that a Bed of Justice should be held as the only means left by which the abrogation of the parliamentary decrees could be registered. But while our arguments were moving, I stopped them all short by a reflection which came into my mind.
The King wished to save them, for he knew that they were the best supporters of the throne of absolutism. But he could not resist the pressure, the torrent of public opinion, the entreaties of his mistress, the arguments of his ministers. He was compelled to demand from the Pope the abrogation of their charter.
And they may have to fight also, it appears, against the abrogation of our existing constitution in favour of a system of quinquennial dictatorships. For that and nothing else is involved in the proposal to reduce the House of Lords to impotence and put nothing in its place. What is the purport of the memorial? It is plainly this; to reprobate a particular kind of commerce, in a moral view, and to request the interposition of Congress to effect its abrogation.
But the very term "suspension" shows that the power conferred is but temporary, otherwise it would be synonymous with abrogation. And all parties may wisely agree, as they did in this instance, to a temporary suspension of the people's rights, though there would be none to whom their permanent abrogation would not be intolerable.
It was alleged in excuse that the treaty provided for its own abrogation; but of course it is infinitely better to have a treaty under which the power to exercise a necessary right is explicitly retained rather than a treaty so drawn that recourse must be had to the extreme step of abrogating if it ever becomes necessary to exercise the right in question.
I urged as strongly as I could, but without success, the advisability of releasing the whole; and I was obliged, at last, to content myself with the mass, and yield the few whom I could only have got by force or the utter abrogation of our infant treaty.
We deliberately refrain nevertheless from doing so, because the whole nature of the sixteenth-century literature was different from that of the fourteenth and fifteenth; the early years of the sixteenth century witnessed the abrogation of the central authority which was a basic condition of the success of the mediæval system; and the same period also witnessed 'radical economic changes, reacting more and more on the scholastic doctrines, which found fewer and fewer defenders in their original form.
On the day following the landing of the marines, the Committee of Safety, under the chairmanship of Judge Dole, who had resigned as Justice of the Supreme Court of Hawaii in order to accept the Chairmanship of the Committee, proceeded to the government building, and there, under cover of the guns of the United States Marines, who were drawn up for the purpose of protecting the Committee against possible attack, a proclamation was read, declaring the abrogation of the Hawaiian monarchy, and the establishment of a provisional government "to exist until terms of union with the United States have been negotiated and agreed upon."
