This point should never be surrendered or compromised. Whatever is established, let it be equal, and let it be legal. Let men know, to-day, what money may be required of them to-morrow. Let the rule be open and public, on the pages of the statute-book, not a secret, in the executive breast.
To answer this you must have a thorough acquaintance with biology, geology, astronomy, besides deciding for yourself between the conflicting views at nearly every point. By the time you have made up your mind as to whether capital punishment should be abolished, it has passed out of the statute-book, and you are dead, or mad, or murdered.
The reign of Law, broken and disturbed by a hundred storms, but still henceforward with a statute-book to fall back upon and some fitful authority at its command, began in Scotland in his day. There are some curious details in the Scotichronicon about the taxes, now, it would seem, for the first time levied upon the general mass of the people.
Twice Prime Minister in periods of storm and stress, he had left his mark, directly or indirectly, on the statute-book in much progressive legislation, and, in spite of mistakes in policy, had at length quitted office with the reputation of an honest and enlightened statesman.
“What do we talk of marks and brands, whether on the bodice of her gown, or the flesh of her forehead?” cried another female, the ugliest as well as the most pitiless of these self-constituted judges. “This woman has brought shame upon us all, and ought to die. Is there not law for it? Truly, there is, both in the Scripture and the statute-book.
They habitually violated numerous laws on the statute-book, ranging from those requiring good order to those forbidding what was construed as blasphemy. In 1660 Charles II. was recalled to the throne. This event was a restoration of the church even more than a restoration of the monarchy.
Then came the Mutiny, which in its essence was the breakdown of an old system; the renunciation of an attempt to effect an impossible compromise between the Asiatic and the European view of things, legal, military, and administrative. The effect of the Mutiny on the Statute-book was unmistakable. The Code of Civil Procedure was enacted in 1859.
If such verdicts are to be rendered, we may as well blot out from the statute-book all punishment for all crimes in which the evidence is largely circumstantial. If ever a strong case was made out against a human being it was the case of the prosecution in the recent trial.
The result was the wretched existence to which the labour class was doomed, "a life so wretched that even a beast's life seems enviable." No such cry of pity for the poor, of protest against the system of agrarian and manufacturing tyranny which found its expression in the Statute-book had been heard since the days of Piers Ploughman. But from Christendom More turns with a smile to "Nowhere."
But what was my surprise, on looking into the late report of the Secret Committee of the Lords, to find a list of these bills during the war, differing in every year, and larger on the whole by nearly one third! I have checked this account by the statute-book, and find it to be correct. What new brilliancy, then, does it throw over the prospect, bright as it was before! I cannot stop here.
