Lord George Murray at once set about raising the tenantry of his brother the Hanoverian Duke of Athole, who was absent in England, and as these had always remained attached to the Stuart cause, and still regarded the Marquis of Tullibardine as their rightful head, they willingly took up arms upon Lord George Murray's bidding.
These two vessels reached the coast of Scotland, having on board of them the Earl of Seaforth, the Earl Marischal, the Marquis of Tullibardine, three hundred Spaniards, and arms for two thousand men. They landed at the island of Lewes, but found the body of the Jacobite party resolved not to move until all the forces under Ormond should be assembled.
Recourse was had to several of the most able lawyers of the kingdom, and their opinion unanimously was, that Lord Tullibardine had no more right to make his "niece heiress of Lovat than to put her in possession of the throne of Scotland: that the right of Thomas of Beaufort to those honours and estates was incontrovertible, and that the King himself would not deprive him of them, except for high treason."

This, at least, was the story given under examination by Mr. Thomas Cranstoun, Gowrie’s master stabler, while other witnesses mention that Gowrie became involved in a struggle, and went ‘back from’ his house, further up or down the street.
Hearing the town bell he hastened in, ‘when all the tumult was ceased,’ and the magistrates, Ray and others, were sending the people to their houses, as also did young Tullibardine. A baker, hearing the bell, went to the town cross, and so to Gowrie’s house, where he met the stream of people coming away.
It only served to quicken their pace, and they ran forward shooting rapidly the while. An order was sent to the Camel Corps to retire at once, as the dervishes were seen to be trying to cut them off by advancing on both sides of the hill. Before the order carried by Lieutenant Lord Tullibardine actually reached them, they had suffered severely and were falling back.
His efforts were the more successful, because King William had by this time begun to suspect the fidelity of Lord Tullibardine, and to place a strong reliance upon the integrity and abilities of the Duke of Argyle.
It is singular that, beholding his father thus cherished by Government, the Marquis of Tullibardine should have adopted the cause of the Chevalier: and not, as it appears, from a momentary caprice, but, if we take into consideration the conduct of his whole life, from a fixed and unalienable conviction.
It is consolatory to reflect that the Marquis of Tullibardine, after a life spent in an honest devotion to the cause which he believed to be just, was spared, by a merciful release, from the horrors of a public trial, and of a condemnation to the scaffold, which age and ill-health were not sufficient pleas to avert.
The Commission then in power, by appointment of the Assembly of June 1646, consisted of eighty-nine ministers and about as many lay-elders; and among these latter were the Marquis of Argyle, the Earls of Crawford, Marischal, Glencairn, Cassilis, Dunfermline, Tullibardine, Buccleuch, Lothian, and Lanark, besides many other lords and lairds.
