Metaphysician, b. in Glasgow, in the Univ. of which his f. and grandfather successively filled the Chair of Anatomy and Botany, ed. there and at Balliol Coll., Oxf., was called to the Scottish Bar, at which he attained little practice, but was appointed Solicitor of Teinds. In 1816 he established his claim to the baronetcy of H. of Preston. On the death of Dr.

But the wonderful beauty seemed to him to have in it something terrible and weird, like that fairyland of his native country, whose glory and charm is overshadowed by the knowledge of the teinds to be paid to hell.

The main result was that landowners were empowered to buy the tithes on their own lands from the multitude of "titulars of tithes" who had rapaciously and oppressively extorted these tenths of the harvest every year. The ministers had a safe provision at last, secured on the tithes, in Scotland styled "teinds," but this did not reconcile most of them to bishops and to the Articles of Perth.

But they are alike destitute of manly resolution and sound policy. D n the whole nest of them! I have corrected the last of Malachi, and let the thing take its chance. I have made enemies enough, and indisposed enough of friends. March 8. At the Court, though a teind day. A foolish thing happened while the Court were engaged with the teinds.

All over Protestant Europe the conclusion even of the wise and just was, that, subject to proper qualifications, the ancient endowments of the Church were now the treasury of the people. But there was another part of the patrimony of the old Church on which Knox had a still stronger opinion viz., the yearly tithes or Teinds.

This notion I weighed well before divulging it to any person; but when I had assured myself as to the rectitude thereof, I rode over one day to Mr Kibbock's, and broke my mind to him about claiming out of the teinds an augmentation of my stipend, not because I needed it, but in case, after me, some bare and hungry gorbie of the Lord should be sent upon the parish, in no such condition to plea with the heritors as I was.

Rutherfurd thought that he informed his father of the cause of his distress, adding that the payment of a considerable sum of money was the more unpleasant to him, because he had a strong consciousness that it was not due, though he was unable to recover any evidence in support of his belief, "You are right, my son," replied the paternal shade; "I did acquire right to these teinds, for payment of which you are now prosecuted.

It was fit that between these two later Acts should be interposed another, giving the ministers a first claim on the 'thirds' of benefices, 'aye and until the Kirk come to the full possession of their proper patrimony, which is the teinds. The proper patrimony of the ancient Church was, perhaps, rather the endowments which had been gifted to it; yet Knox, who abhorred the idea of inheriting anything from that old Church, took a share of that money, even from the State, with reluctance.

The same Assembly went on to declare that 'the teinds properly pertain to the Kirk, and while they should be applied not only to the ministers, but also to 'the sustentation of the poor, maintaining of schools, repairing of kirks, and other godly uses, such application should be 'at the discretion of the Kirk. It was all right, provided the intolerant establishment were to remain.

And in our own century the Church, retaining its statutory jurisdiction over Catholics and Nonconformists, has lost its statutory control over both the schools and the poor, while it has never got anything like 'full possession' or even administration of the teinds, in which all three were to share, but of which it desired to be sole trustee.
