Punishment is, in all very early stages of society, capricious, mostly unregulated by any definite customs or enactments, and, consequently, often disproportioned, either in the way of excess or defect, to the character of the offence.
As to the cases, Sir, which do not come before the courts, those political questions which terminate with the enactments of Congress, it is of necessity that these should be ultimately decided by Congress itself. Like other legislatures, it must be trusted with this power.
But the pressure of local interests, combined with a speculative spirit, have in many instances procured the passage of laws which marred the harmony of the general plan and encumbered the system with a multitude of general and special enactments which render the land laws complicated, subject the titles to uncertainty, and the purchasers often to oppression and wrong.
The "speaking" of any government must be the public promulgation of its will on the part of its law-making and executive powers. Is this nation, then, to issue unjust and oppressive enactments against the people of God? Are the fires of persecution, which in other ages have devastated other lands, to be lighted here also?
It may also be observed that since the year 1812 the land offices and surveying districts have been greatly multiplied, and that numerous legislative enactments from year to year since that time have imposed a great amount of new and additional duties upon that office, while the want of a timely application of force commensurate with the care and labor required has caused the increasing embarrassment of accumulated arrears in the different branches of the establishment.
There would have been no further amendment to the Constitution, there would have been no conditions of reconstruction, there would have been such a neutralization of the anti-slavery amendment as would authorize and sustain all the State laws already passed for the practical re-enslavement of the negro, with such additional enactments as would have made them cruelly effective.
If it be true anywhere that such enactments are forced on the legislature by public opinion, is Apostasy too hard a word to describe the temper of such a nation?" The sermon was a call to face in earnest a changed state of things, full of immediate and pressing danger; to consider how it was to be met by Christians and Churchmen, and to watch motives and tempers.
Nor did he always adhere strictly to the letter of the laws, but overruled the rigour or lenity of many of their enactments, according to his sentiments of justice and equity. For where persons lost their suits by insisting upon more than appeared to be their due, before the judges of private causes, he granted them the indulgence of a second trial.
You have come forth, the unblushing advocate of American slavery; a system which, whether we study its nature in the deliberate and horrid enactments of its code, or in the heathenism and pollution and sweat and tears and blood, which prove, but too well, the agreement of its practical character with its theory is, beyond all doubt, more oppressive and wicked than any other, which the avaricious, sensual, cruel heart of man ever devised.
Similar enactments were made in future Parliaments with the same object, which had the effect of checking the trade, and several of the Sussex ironmasters were under the necessity of removing their works elsewhere.
