The old distinction of patricians and plebeians had vanished, and a new nobility had arisen, composed of rich men and of those whose ancestors had enjoyed curule magistracies. They possessed the Senate, and had control of the Comitia Centuriata, by the prerogative vote of the equestrian centuries.
Unless, indeed, anything which, for the purpose of recollecting it, he entered in a note-book, is to be counted among his acts, and defended, however unjust or useless it may be; and that which he proposed to the people in the comitia centuriata and carried, is not to be accounted one of the acts of Caesar. But what is that third decury? The decury of centurions, says he.
What assembly was peculiar to the patricians? What were the powers of the Roman kings? What great change was made in the Roman constitution by Servius Tullius? For what purpose was the census instituted? How were votes taken in the comitia centuriata? Were the designs of Servius frustrated? What was the Roman law respecting debtors? When did the Roman power decline?
There, in those waters, the proscribed met, and escaped to Numidia, and Sulla was spared the odium of putting to death his old commander, who had delivered Rome from the Cimbrians. He suggested a new series of legislative enactments in the interests of the aristocracy. He created three hundred new senators, and brought back the old Servian rule of voting in the Comitia Centuriata.
The Assembly of the Centuries, therefore, had all powers which may be supposed to be properly lodged with a General commanding an army, and, among them, it had authority to subject all offenders to the same correction to which a soldier rendered himself liable by breaches of discipline. The Comitia Centuriata could therefore inflict capital punishment.
But he may be confusing things, and only mean that Sulla took the voting power from the Comitia Tributa and vested it in the Comitia Centuriata. And this probably is what Sulla did. This, however, was not enough. It was his object to curtail the powers of every magistrate.
The power granted to the Comitia Centuriata did not suffice to produce contentment. The patricians still decided every thing, and used their strength in an oppressive way. Besides the standing contest between the patricians and plebeians, there was great suffering on the side of the poorer class of plebeians.
But we know that in one way or other a second political division in the State arose and that the constitution, of which Servius Tullius was the reputed author, made every freeman in Rome a citizen by giving him a vote in the Comitia Centuriata.
The non-burgesses indeed gained by it burgess-rights, and the new burgess-body acquired in the -comitia centuriata- comprehensive prerogatives; but the right of rejection on the part of the patrician senate, which in firm and serried ranks confronted the -comitia- as if it were an Upper House, legally hampered their freedom of movement precisely in the most important matters, and although not in a position to thwart the serious will of the collective body, could yet practically delay and cripple it.
Ser'vius Tul'lius undoubtedly intended that the comitia centuriata should form the third estate of the realm, and during his reign they probably held that rank; but when, by an aristocratic insurrection he was slain in the senate-house, the power conceded to the people was again usurped by the patricians, and the comitio centuriata did not recover the right of legislation before the laws of the twelve tables were established.
