The break-up of the Empire through the continual repetition of military strife was accelerated, not caused, by the presence of barbarism both within and without the frontiers. To restore the elements of order a compromise between central and local jurisdictions was necessary, and the vassal became a local prince owning an allegiance, more or less real as the case might be, to a distant sovereign.
The archenemy Strafford had been brought to the block; Laud was in the tower; the leading members of Convocation, bishops, deans, and archdeacons, had been heavily fined; the Star Chamber and the High Commission Court had been abolished; the Stannary and Forestal jurisdictions restrained. But the Puritan movement aimed at far more than this.
Both of these river towns have been retired to the country by that cut- off. A cut-off plays havoc with boundary lines and jurisdictions: for instance, a man is living in the State of Mississippi to-day, a cut-off occurs to-night, and to-morrow the man finds himself and his land over on the other side of the river, within the boundaries and subject to the laws of the State of Louisiana!
It is in this part of the project we must look for the cause of the destruction of all the old bounds of provinces and jurisdictions, ecclesiastical and secular, and the dissolution of all ancient combinations of things, as well as the formation of so many small unconnected republics. The power of the city of Paris is evidently one great spring of all their politics.
This rule is also in force in South Carolina and several other of the American jurisdictions. But, the law which forbids the whole three degrees of Ancient Craft Masonry to be conferred, at the same communication, on one candidate, is universal in its application, and, as such, may be deemed one of the ancient landmarks of the Order.
In the old divisions of the country, various accidents at times, and the ebb and flow of various properties and jurisdictions, settled their bounds. These bounds were not made upon any fixed system, undoubtedly. They were subject to some inconveniences; but they were inconveniences for which use had found remedies, and habit had supplied accommodation and patience.
That service is the common end and object towards which men of all parties in English history have striven through the growth of conscious and collective action. A communist has maintained that we are all communists because we have developed a common army, a common navy, and a common national government, in place of the individualistic forces and jurisdictions of feudal barons.
The jurisdictions of the clergy, therefore, in their particular baronies or manors, were equally independent, and equally exclusive of the authority of the king's courts, as those of the great temporal lords.
The English Church too was most distinctly national; no land came so near to that ideal state of things in which the Church is the nation on its religious side. Papal authority therefore was weaker in England than elsewhere, and a less careful line was drawn between spiritual and temporal things and jurisdictions. Two friendly powers could take liberties with each other.
Any special jurisdictions which still remain are looked upon as instruments of aristocracy; courts-martial are held in abhorrence because they have ideas of their own in respect of military honour and duty, and military offences. Therein lies their efficiency, a thing absolutely necessary, if we are to maintain military spirit and discipline in a strong army.
