In the meantime the German Government which no doubt had not expected such drastic action on the part of the United States was profoundly disturbed, and it was stated that crews of American merchantmen who ventured to fire upon German submarines before a state of war existed between the two countries must expect to meet the fate of the British merchant captain, Charles Fryatt, who as will be recalled, was tried and executed in Germany for attempting to ram the German submarine 7-33 with his vessel, the Great Eastern Railway steamship, Brussels, in July of 1916.

When I heard of this I immediately sent two formal notes to the German Foreign Office demanding the right to see Fryatt and hire counsel to represent him, inquiring what sort of counsel would be permitted to attend the trial and asking for postponement of the trial until these matters could be arranged.

Y was very emphatic in what he said of the attitude of his government and the British people toward continuing the war to an absolutely conclusive end, and I was much impressed. He said among other things that the execution of Captain Fryatt had had a markedly perceptible effect in hardening British public opinion against Germany and fixing the determination to fight to a relentless finish.

As to the evidence regarding the watch, the British Foreign Office learned that, when captured, Captain Fryatt had neither a watch nor any letter to indicate that he had tried to ram a submarine!

The German Foreign Office had informed me that they had backed up these requests and I believe them, but the answer of the German admiralty to my notes was to cause the trial to proceed the morning after the day on which my notes were delivered and to shoot Fryatt before noon of the same day.

They thought the same of Zeppelin raids over England. Intimidation was their guiding star in Belgium. The first I heard of the massacre of Louvain was from one of its perpetrators. Intimidation was again their weapon in the case of Captain Fryatt.

Captain Fryatt attempted to ram the nearest vessel and escape, but the effort failed and he was arrested and charged with piracy. Germany had announced early in the war that she would consider any merchant captain who made a hostile move, even in defense of his vessel, as a franc-tireur.

If, without being attached to the forces of the enemy, they take part in hostilities or make forcible resistance, they may be treated according to the usages of war. If President Wilson, knowing these provisions of international law, proceeds to arm American merchantmen he must assume responsibility for the eventuality that American seamen will meet the fate of Captain Fryatt."

The advance on the Somme had been slow, but it was the Germans who were in retreat; the German Navy had been demoralized at Jutland; and Germany's only retaliation had been the judicial murder of Captain Fryatt on 27 July on a charge of having defended himself against a submarine.

You see, when the next British captain thinks of ramming one of our submarines he will remember the fate of Captain Fryatt and think twice!" Once more Germany is attempting intimidation, and seeking to make neutrals her ally in an attempt to starve Britain into defeat.
