Each of these concordats supposes that the Pope possesses some power in the country, which he is enabled to concede to the sovereign with whom the concordat is made. That is a point which we can never yield to any sovereign whatever. There is no sovereign, be he who he may, who has any power in this country to confer upon his majesty. We must keep our sovereign clear from such transactions.
He was right: in healing a great schism in France he was dealing a deadly blow at the revolutionary feeling of which it was a prominent manifestation. In the words of one of his Ministers, "The Concordat was the most brilliant triumph over the genius of Revolution, and all the following successes have without exception resulted from it."
This year the 14th of July fell on a Saturday, and the Emperor ordered its celebration to be delayed till the following day, because it was Sunday; which was in conformity with the sentiments he delivered respecting the Concordat. By this Concordat the Pope "declares that neither himself nor his successors shall in any manner disturb the purchasers of alienated ecclesiastical property, and that the ownership of the said property, the rights and revenues derived therefrom, shall consequently remain incommutable in their hands or in those of their assigns." There remain the institutions for instruction.
In relation to his ecclesiastical superiors he was respectful but independent. The bishop in his diocese was not what he has become since the Concordat, an absolute sovereign free to appoint and remove at will nine cures out of ten.
During the six months which usually follow the notification of appointments made by the Emperor to the archbishoprics and bishoprics of the Empire and the Kingdom of Italy the Pope shall perform the canonical institution in conformity with the Concordat, and by virtue of the present agreement; previous information concerning which shall be given by the archbishop.
In France, the concordat of 1516 between pope and king had peacefully secured for the French monarch appointment of bishops and control of benefices within his country, powers which the German princes and the English sovereigns secured by revolutionary change.
