In spite of the formation of extraordinary tribunals, the great Code of Civil Law was being slowly made destined to rule France and extend her useful action. An agent, almost unknown at Rome and only recently arrived in Paris, was already discussing with Abbe Bernier those great questions of order and organization which were afterwards to introduce the concordat.

But being influenced by some of the cardinals who had previously incurred the Emperor's displeasure Pius VII. disavowed the new Concordat which he had been weak enough to grant, and the Emperor, who then had more important affairs on his hands, dismissed the Holy Father, and published the act to which he had assented.

The project of the Concordat was sharply opposed in the Tribunate, which also ventured to declare that the first sections of the Civil Codes were not conformable to the principles of 1789 and to the first draft of a code presented to the Convention.

Everything having been settled and prearranged, the Emperor and the Pope signed on the 25th an agreement under the name of Concordat, of which this is the purport: "His Majesty, the Emperor and King, and his Holiness, wishing to settle the differences which had arisen between them, and provide for difficulties which have unexpectedly arisen in regard to various affairs of the church, have agreed on the following articles as forming a basis for a definite arrangement: ART. 1.

The 'Pragmatic Sanction of Bourgea', which now for nearly a century had secured to the Church of France independence in the choice of her chief officers, was replaced by a concordat, whereby the King allowed the papacy once more to drain the wealth of the Church of France, while the Pope allowed the King almost autocratic power over it.

Subsequent events have proved that he had reason for his apprehension. "The flight of a notary of Paris who carried off the funds which Birotteau had deposited in his hands, caused the fall of your petitioner," he resumed. "The Court rendered in that matter a decree which showed to what extent the confidence of Roguin's clients had been betrayed. A concordat was held.

Five months afterwards, on the 5th of February, 1517, the king repaired in person to Parliament, to which he had summoned many prelates and doctors of the University. The chancellor explained the points of the Concordat, and recapitulated all the facts which, according to him, had made it necessary.

When the Concordat of 1801 was concluded, Consalvi rejoiced that he had done so well, for he was empowered, if necessary, to make still greater concessions. The revolutionary canonists were persuaded that the Pope, if he rejected the king's overtures, would be acting as the instrument of the aristocratic party, and would be governed by calculated advantage, not by conscience.

This double personal conviction is in the back-ground of his thinking, when he drafted the Concordat: "It will be said that I am a papist. I am nothing. In Egypt I was a Moslem; here I shall be a Catholic, for the good of the people. I do not believe in religions. The idea of a God!" Imagination has already decorated this great name with its legends.
