Unfair decision of the Roman people, who being chosen arbitrators between the people of Ardea and Aricia concerning some disputed lands, adjudge them to themselves. After the taking of Antium, Titus Æmilius and Quintus Fabius are elected consuls. This was the Fabius Quintus who alone had survived the family cut off at Cremera.

Earlier or later, the seed sown, so he foreboded, must be again stifled and the tender fruit sunk under the rank growth of sprouting weeds. Meanwhile the arbitrators in Steinhausen did all they could, and when Bern used just as decided language against the Five Cantons as against Zurich, then a treaty was formed, with which the statesmen of the latter canton said they would be satisfied.

Of those cases which were determined, some, relating to ships, were found to be particularly intricate, and cost the arbitrators considerable time and trouble. The verdicts, however, which were given, were in all of them satisfactory. The Institution, at length became so popular, that, incredible to relate, its own popularity destroyed it!

For the settlement of any disputes that may arise, arbitrators are chosen, who make their decisions verbally, and from whom there is an appeal to the Board of Arbitrators.

When the examination has been thus completed, they proceed to the stone on which are the pieces of the victims, and on which the Arbitrators take oath before declaring their decisions, and witnesses swear to their testimony.

It was only by a railway strike, or perhaps by a seamen's or miners' strike that it could be put to a real test. By the settlement of the threatened railway strike of 1907 the employees had gained very little, and had voluntarily left the final power to decide disputes in the hands of government arbitrators. A conservative Labourite, Mr. J. R. MacDonald, writing late in 1910, said:

The arbitrators, although they are governed by principles of law, know what is expected of them, and they rarely disappoint. Almost invariably their decision is a compromise, so nicely shaded that while neither side can claim victory neither side suffers the humiliation of defeat.

The only questions which latterly retarded the conclusion of the treaty related to the compensation to be made to the merchants for the depredations on their trade in the East Indies before, and the detention of their ships by the king of Denmark during, the war. It was, however, agreed that arbitrators should be chosen out of both nations, and that each government should be bound by their award.

He did not discover for several hours that he was a prisoner, or in fact understand the process of being surrendered by one's bail. He regained his liberty in a few weeks; and the arbitrators between him and Miss Fry, made their award against him.

I am not quite sure that in the end we administered justice, but certainly employers, trade-unionists, and arbitrators were all convinced that justice will have to be established in industrial affairs with the same care and patience which has been necessary for centuries in order to institute it in men's civic relationships, although as the judge remarked the search must be conducted without much help from precedent.
