Often as I rode behind my caravan, and gazed at the grotesque figures which bore my wares in front of me, I found it hard to believe that it was indeed reality, and that it was I, I, Manuel Ducas, who lived near the Theodosian Gate of Constantinople, and shouted for the Green at the hippodrome every Sunday afternoon, who was there in so strange a land and with such singular comrades.
In the first year of his reign, he directed the faithful Tribonian, and nine learned associates, to revise the ordinances of his predecessors, as they were contained, since the time of Adrian, in the Gregorian Hermogenian, and Theodosian codes; to purge the errors and contradictions, to retrench whatever was obsolete or superfluous, and to select the wise and salutary laws best adapted to the practice of the tribunals and the use of his subjects.
But strange and anomalous as the Cæsarean succession appears, that of the Byzantine sovereigns, from the disappearance of the Theodosian race to the last Constantine who dies on the ramparts of the city made by the first, shows a great deterioration. There was no acknowledged principle of succession. Arbitrary force determined it.
In 457, the Theodosian house becomes extinct in the East by the death of the emperor Marcian, before whom the heiress of the empire, St. Pulcheria, granddaughter of the great Thedosius, had died in 453. He was succeeded by Leo, a soldier of fortune, but an orthodox emperor, who supported St. Leo.
Immediately on his accession Justinian set himself to collect and codify the principal imperial constitutions or statutes enacted prior to, and in force at, the date of his accession. In this respect he followed the example set by his predecessor, Theodosian.
After the death of Alexander Severus, 235 A.D., no great accession was made to Roman law until Theodosius II., 438 A.D., caused the constitutions, from Constantine to his own time, to be collected and arranged in sixteen books. This was called the Theodosian Code, which in the West was held in high esteem.
Besides this, his wife, Serena, probably endeavored to check his policy of discord and maintain unity in the Theodosian house.
The widow of Valentinian, Eudoxia, whom he had led captive from Rome to Carthage, was the sole heiress of the Theodosian house; her elder daughter, Eudocia, became the reluctant wife of Hunneric, his eldest son; and the stern father, asserting a legal claim, which could not easily be refuted or satisfied, demanded a just proportion of the Imperial patrimony.
Living thus not only in peace and plenty, but even in honour and luxury, "the proud Patriarch of the Theodosian Church" could not consistently fulminate against "the ravenous wolves" with whom he was on friendly terms, or excite the fanaticism of his followers by highly coloured descriptions of "the awful sufferings and persecution of God's people in these latter days," as the founder of the sect had been wont to do.
About the end of the century appeared a new code from the pen of Ivo, Bishop of Chartres, whose acquaintance with the civil law of Rome enabled him to give to his work a superiority over the compilations of his predecessors. Yet the knowledge of Ivo must have been confined to the Theodosian code, the institutes and mutilated extracts from the pandects of Justinian.
