The Non-Importation Act had just gone into effect. Jefferson immediately called his Cabinet together. All were of one mind. The impending order-in-council, it was agreed, left but one alternative. Commerce must be totally suspended until the full scope of these new aggressions could be ascertained.
It was in connection with these grants that the name of "United Empire Loyalists" originated. An order-in-council was passed on the 9th of November, 1780, in accordance with the wish of Lord Dorchester "to put a mark of honour upon the families who had adhered to the unity of the empire and joined the royal standard in America before the treaty of separation in 1783."
Some days after these events, a clerk named Rouvier, in the employ of de Caën, arrived with letters from Dolu, de Villemenon, and Guillaume de Caën, and left a copy of an order-in-council in favour of the old company. Champlain also received a letter from the king.
Section 2 of the 1908 Act empowers the Governor-General by Order-in-Council to appoint any person to be a Commission to inquire into and report upon any question arising out of or concerning a range of matters. The Australian Acts presuppose the existence of Commissions appointed under prerogative or inherent executive powers and merely confer ancillary powers of compelling evidence and the like.
The old company received five-twelfths of the Company of Montmorency, one-twelfth of which was reserved by de Monts, who was at that time living at his residence in Saintonge. By this latter arrangement, however, the de Caëns were relieved from the payment of the ten thousand livres imposed upon them by the order-in-council.
The order-in-council establishing this large company granted to them the liberty of trading in New France, and all French subjects were eligible for admission to the society. By this arrangement the de Caëns were obliged to pay the sum of ten thousand livres to the members of the old Rouen association, and a sum equal to the value of their goods, barques and canoes.
Another order-in-council, November 17, 1807, closed to neutrals all European ports under French control, "as if the same were actually blockaded," but permitted vessels which first entered a British port and obtained a British license to sail to any continental port. It was an order which, as Henry Adams has said, could have but one purpose to make American commerce English.
It is true, this soldier-king, whose regiments were his State, was incensed at all this in the highest degree, and that he forthwith, in November, 1723, issued an order-in-council against Wolf, ordering him on penalty of the halter, to leave Prussian ground within twice twenty-four hours and Wolf was obliged to flee.
In accordance with this provision Sir Mackenzie Bowell's government passed an order-in-council on the 21st March, 1895, calling upon the government of Manitoba to take the necessary measures to restore to the Roman Catholic minority such rights and privileges as were declared by the highest court of the empire to have been taken away from them.
Meanwhile preparations went forward in earnest for the "Christmas Carol," and "All costumes must be finished for Monday. Full rehearsal at eight o'clock in the Big Hall." So ran the Order-in-Council. "I'm certainly glad Tiny Tim's costume is done," thought Judith as she ran downstairs for the rehearsal; "four more days till the literature exam. I'm going to work like everything."
