This doctrine that workingmen may lawfully organize trade unions has since Commonwealth v. Hunt been adopted in nearly every case. The other doctrine which Justice Shaw advanced in this case has been less generally accepted. It was that the members of a union may procure the discharge of non-members through strikes for this purpose against their employers.
When coöperative organizations were first formed it was found that by the common law they could not legally deal as societies with non-members; that they could not hold land for investment, or for any other purpose than the transaction of their own business, or more than one acre even for this purpose; that they could not loan money to other societies; that the embezzlement or misuse of their funds by their officers was not punishable; and that each member was responsible for the debts of the whole society.
Exclusion was very pleasant in the bright days of summer; but, on one occasion in December, decidedly unpleasant for the seven-year-old Susan. When the blinds were drawn, at the close of the religious meeting, and non-members retired, Susan sat still. Soon she saw a thin old lady with blue goggles come down from the "high seat."
