Here fell gloriously, at the moment of victory, DICK, the veteran of the Peninsula and Waterloo, "displaying the same energy and intrepidity as when, thirty-five years ago, in Spain, he was the distinguished leader of the 42d Highlanders." No better man no better soldier sleeps the sleep of the brave.

Twice they essayed to cross, and twice the death-dealing fire of our guns covered the narrow bridge with slain, while by the wild pibroch of the 42d, swelling madly into notes of exultation and triumph, the Highlanders could scarcely be prevented from advancing hand to hand with the foe.

The 42d, misunderstanding orders, retired towards the hill, and the French, being reinforced, again attacked Elvina, which the 50th held stubbornly until again joined by the 42d, which had been sent forward by Moore himself.

Owing to the extreme thickness of the wood and their ignorance of the nature of the ground these columns were unable to keep in their proper position, and diverged considerably. The Ashantis, however, made no effort to penetrate between them and the 42d. For an hour this state of things continued.

All the guards were relieved, all the sentinels changed, and the battalion of the night guard was sent back to the camp of the Invalides, the soldiers piled their arms in the avenue, and in the Cour d'Honneur. The 42d, in profound silence, occupied the doors outside and inside, the courtyard, the reception-rooms, the galleries, the corridors, the passages, while every one slept in the Palace.

From the mouth of the Sabine to the Rocky mountains, they are separated from Spanish America by a line which pursues an irregular north-western direction to the 42d degree of north latitude, whence it proceeds west, to the Pacific.

Long before dawn on the 1st of January, 1863, under cover of a heavy artillery fire, the position of the 42d Massachusetts was assaulted by two storming parties of 300 and 500 men respectively, led by Colonels Green, Bagby, and Cook, the remainder of the troops being formed under Scurry in support.

Then came the main body of the army, the provincials, dressed in blue with red facings, on the right and left wings. In the centre were the regulars, in scarlet with white facings, and the 42d Regiment, the Black Watch, in kilts and tartans. Behind them came the rear guard of provincials. The whole army was on the lake as the sun rose, breaking up the mist on the hillsides.

And a Highlander of the 42d Regiment, in his printed memoirs, notices the same harbinger of evil as having crossed his own path on a day of personal disaster in Spain. Birds are even more familiarly associated with such ominous warnings. This chapter in the great volume of superstition was indeed cultivated with unusual solicitude amongst the Pagans ornithomancy grew into an elaborate science.

The Congressional law under which the prosecution of Mrs. Slenker has been instituted, is a specimen of hasty legislation, rushed through in the last hours of the 42d session, more than one-half of all the acts being passed on the last day and night amid the most disgraceful confusion and uproar.
