He bought the whole south side of Pine Street from Second to Third from the Penns in 1761, and for many years the house was surrounded by a garden containing flowers, shrubs and fruit trees. The severity of this sentence was not, the judge said, intended to mark the strong suspicion under which Butler laboured of being a murderer as well as a burglar.

An expedition despatched in this direction came upon Trivulzio with a strong force of cavalry, posted at a pass called Stamper's Hook, which controlled the first of these streams. The narrowness of the pathway gave the advantage to the Italian commander. A warm action took place, in which the republican cavalry were worsted, and Paul Bax severely wounded.

A great deal of the evidence as to his conduct and demeanour at the time of the murder Butler met by acknowledging that it was he who had broken into Mr. Stamper's house on the Saturday morning, burgled it and set it on fire. His consciousness of guilt in this respect was, he said, quite sufficient to account for anything strange or furtive in his manner at that time.
