In the event of the Court, contemplated by Article 8 of the Amendment of the Grondwet of 1877, declaring the State President, or the Supreme Court, contemplated by Article 115 of the Grondwet, declaring the Commandant-General or other members of the Executive unfit to occupy his or their office, the Chairman of the Volksraad, upon the receipt of the decision of such Court, shall convene the members of the Volksraad, who shall be bound to attend, in order to dismiss the official or officials found guilty; and to provide for the filling up of the vacancy or vacancies so caused.
Two persons possessing the qualifications for officials according to the Grondwet are proposed to the enfranchised burghers of the district concerned, so as at the very latest within the period of two months to decide between the two such candidates by free voting, and to give written notice of the result of such voting to the Executive Council.
WHEREAS, These amendments will not permit of delay by being published three months beforehand in terms of Article 12 of the Grondwet, and as they have already been accepted by the people in principle; it is hereby enacted that: ARTICLE 1.
Their Grondwet, or Constitution, must be removed out of its place for ever; their unequal laws, and the administrative corruption which unequal laws inevitably foster, must be swept away, and be replaced by a very different Constitution and very different Laws.

The Grondwet, or Constitution, provided that to prevent abuses in legislation, no new law should be passed until the bill for it had been published three months in advance. To evade this, Kruger passed all kinds of measures as amendments to existing laws; which, as he explained, not being new laws, required no notification!
