In declaring war and making treaties, the consent of the Bundesrath is required. The following articles also give the Bundesrath a very complete control of the Reichstag.

Another reason against the direct annexation of foreign countries lay in the Constitution of the Empire; it would have been easier to annex fresh land to Prussia; this could have been done by the authority of the King; there was, however, no provision by which the Bundesrath could undertake this responsibility, and it probably could not be done even with the assent of the Reichstag unless some change were made in the Constitution.

The German consul at Durban reported that no contraband had been found on the Bundesrath although a thorough search had been made. The failure to discover goods of a contraband character apparently rendered the action of Great Britain's naval authorities unjustifiable.

But by the same standard, it was contended that the act of seizing and conveying to Durban the Bundesrath and the Herzog, and the act of discharging the cargoes of the Bundesrath and General, were both undertaken upon insufficiently founded suspicion and did not appear to have been justified.

Moreover, "it is understood also that during the Boer War, when British authorities seized the German vessels, the Herzog, the General and the Bundesrath, and released them without prize court proceedings, compensation for damages suffered was arranged through diplomatic channels."

In October 1879 they gained local representative institutions, but under the strict control of the Governor, Marshal von Manteuffel. The Prussian Government nominates seventeen members; Bavaria six; Saxony and Würtemburg and Alsace-Lorraine four each; and so on. The Bundesrath is presided over by the Imperial Chancellor.

To the Emperor belongs the right of preparing and publishing the laws of the Empire: they must be passed by the Bundesrath and Reichstag, and then receive the assent of the Kaiser. They are then countersigned by the Chancellor, who thereby becomes responsible for their due execution. In 1874 the conquered lands returned deputies to the Reichstag.

The Bundesrath takes action on the measures to be proposed to the Reichstag and the resolutions passed by that body; it also supervises the execution of laws, and may point out any defects in the laws or in their execution. It sits for three years, but may be dissolved by a resolution of the Bundesrath, with the consent of the Emperor.

The chancellor of the empire, who is also prime minister of Prussia, with several secretaries of state, is chief minister for all imperial affairs. The chancellor presides in the Bundesrath, and has the right to speak in the Reichstag, and frequently does speak there. Indeed, all his more important pronouncements are made there.

THE BUNDESRATH. It was reported to the English Government by Rear Admiral Sir Robert Harris, on December 5, 1899, that the German East African mail steamer Bundesrath had sailed from Aden for Delagoa Bay.
