In May, 1807, an expedition comprising several frigates and transports with 5,000 troops appeared off Montevideo from England. A month later Lieutenant-General Whitelock arrived with orders to assume the chief command, and among his officers were the gallant Irishmen, Major Vandeleur, who commanded a wing of the 88th Regiment, and Lieutenant-Colonel Nugent, of the 38th.
The first, 2400 strong consisting of the 38th, 41st, and 47th Regiments, three native battalions, the troop of bodyguard; a battery of Bengal horse artillery, and part of the rocket company was to march by land.
The 38th Dogras were, however, tolerably fresh, and Colonel Goldney, who commanded in the absence of the General, at once ordered four companies to parade and march to the relief. Captain Cole volunteered to accompany them with a dozen sowars. The horses were saddled. But the order was countermanded, and no troops left the camp that night.

Lawrence's 5th, and Clark's 11th Massachusetts, with Gorman's 1st Minnesota, all belonging to Franklin's Brigade together with Corcoran's 69th New York, of Sherman's Brigade, have been brought into line-of-battle, by the united efforts of Franklin, Averell, and other officers, at our centre, and with the remnants of two or three other regiments, are moving against the Enemy's centre, to support the attack of the Chasseurs-rallied and led forward again by Heintzelman upon the Rebel left, and that of the 38th New York upon the Rebel left centre, in another effort to recapture the abandoned batteries.
Shortly after five o'clock the 53d Massachusetts relieved the 38th, which had expended its ammunition, and was falling back under orders to replenish. When this was done, the 38th once more advanced and formed in support of the skirmish line.

Fiske formed his men in two lines, the 13th Connecticut and the 1st Louisiana in front, supported by James Smith with the 38th Massachusetts and the 128th New York. To Fessenden Birge gave the duty of carrying the hill.
