The suppression of the tribunate, therefore, appeared to the general public like final proceedings in bankruptcy. Some of the members went into the legislature, some into official administrative positions, and the right of discussion in committee behind closed doors was transferred to certain sections of the legislature.

From lists selected by general election, the Senate was to designate a Tribunate and a Legislative Body. The First Consul, in addition to conducting the administration and foreign policies and having charge of the army, was to propose, through a Council of State, all the laws. The Tribunate was to discuss the laws without voting on them.

None of these branches has any right to organize itself: that must be done by the law. Therefore we must make a body which shall organize the manner of deliberations of these three branches. The Tribunate ought to be divided into five sections.

It was the suppression pure and simple, by a "senatus-consulte," of the "Tribunate" formerly instituted with so much pomp, and which had gradually fallen into insignificance, owing to the successive changes it had undergone, and to the secrecy imposed on its deliberations. The absolute power could support neither contradiction nor even the appearance of discussion, however moderate it might be.

To these was added probably only in consequence of the Publilian law, and with a view to bring about the inequality, which was desirable for voting purposes, in the total number of the divisions as a twenty-first tribe the Crustuminian, which derived its name from the place where the plebs had constituted itself as such and had established the tribunate; and thenceforth the special assemblies of the plebs took place, no longer by curies, but by tribes.

Lastly it was added that the holding of the tribunate should in future disqualify for the undertaking of a higher office an enactment which, like many other points in Sulla's restoration, once more reverted to the old patrician maxims, and, just as in the times before the admission of the plebeians to the civil magistracies, declared the tribunate and the curule offices to be mutually incompatible.

The tribune Curee opened the debate in the tribunate by a motion on the subject. He dwelt on the same motives as the senators had done. His proposition was carried with enthusiasm.

All those who behaved ill to me, were cautious in concealing that they did so for fear of incurring the displeasure of the first consul. Fouche, the minister of police, sent for me to say, that the first consul suspected me of having excited my friend who had spoken in the tribunate.
