When carried away by his subject Pliny spoke with such vehemence as to endanger his delicate lungs, and he tells us with no small complacency that the emperor sent him a special message "to be careful of his health." But his greatest triumph was the accusation of Publicius Certus, a senator, and expectant of the consulship.

This is called the Publician action, because it was first placed in the Edict by a praetor called Publicius.

But, though there were four military tribunes there, Fabius Maximus of the first legion, whose father had been dictator the former year; and of the second legion, Lucius Publicius Bibulus and Publius Cornelius Scipio; and of the third legion, Appius Claudius Pulcher, who had been aedile the last year; by the consent of all, the supreme command was vested in Publius Scipio, then a very young man, and Appius Claudius.

When at length, in 96, the Emperor was assassinated in the palace, and the Senate raised Nerva to the purple, Pliny stepped forward as the champion of the oppressed, and impeached Publicius Certus for compassing the death of Helvidius Priscus, though he was only so far successful that he prevented Certus from enjoying the consulship which had been promised him.
