Immediately after his return to the city, however, he secluded himself from public observation, never appearing in the streets, nor on the balconies of his mansion-house. He even encompassed his residence with an armed guard. Gradually, nevertheless, the necessities of the people induced a modification of this system of non-intercourse.
By its own limitations the Non-Intercourse Act was to expire at the end of the approaching spring session of the new Congress, but it was renewed by that body to the end of the winter session. During the recess the Jackson episode occurred, and was the first subject to engage attention on reassembling, November 27, 1809.
It was in vain that Britain pleaded that the Emperor's promises remained unfulfilled, that neither of the decrees was withdrawn, that Napoleon had failed to return the American merchandise seized under them, and that the enforcement of non-intercourse with England was thus an unjust act, and an act of hostility.
Trickery of Napoleon.% And now Napoleon came forward and assured the American minister that the Berlin and Milan Decrees should be recalled on November 1, 1810, provided the United States would restore non-intercourse with England.
In its stead was adopted an Act which repealed that of Non-Intercourse, but prescribed that in case either Great Britain or France, before March 3, 1811, should so revoke or modify its edicts as that they should cease to violate the neutral commerce of the United States, the President should declare the fact by proclamation; and if the other nation should not, within three months from the date of such proclamation, in like manner so modify or revoke its edicts, there should revive against it those sections of the Non-Intercourse Act which excluded its vessels from American ports, and forbade to American vessels importation from its ports, or of its goods from any part of the world whatsoever.
Madison accordingly reimposed non-intercourse with England on the date named, and considered the French decrees withdrawn. The situation was regarded by him as though he had entered into a contract with Napoleon, which compelled him to assert that the decrees were at an end, although he had no other evidence than the existence of the situation arising from the Macon Bill.
In February, 1809, accordingly, the embargo laws, after fourteen months' duration, were repealed. Instead of them the Republicans enacted a Non-intercourse law which allowed the people to trade with all nations except England and France. III., pp. 279-338; Adams's History, Vol.
Zubly hoped they would have to rely for reconciliation upon a vigorous prosecution of the war; in which case the non-intercourse measures were likely to prove an obstacle rather than an advantage, since they would make it difficult, if not impossible, to obtain the "means of carrying on the war."
In place of this injudicious measure a system of non-intercourse with both England and France was substituted as long as either should continue its restrictive measures against the United States.
Would a treaty provision to employ this method be constitutional? "As to this my mind is less clear. The Constitution in delegating powers to Congress includes the regulation of commerce. Does non-intercourse fall within the idea of regulation? Could an embargo be imposed without an act of Congress?
