The mere verbal implication would as much authorize the people to use arms for unjust, as for just, purposes. But the legal implication gives only an authority for their innocent use. And why? Simply because justice is the end of all law the legitimate end of all compacts of government. It is itself law; and there is no right or power among men to destroy its obligation. Take another case.
In his speech before the U.S. Senate in January, 1861, he reminded his hearers that the Southern States had hundreds of sympathizers among the men of the North, "who respect their oaths, abide by compacts, and love justice."
Before examining the language of the Constitution, in regard to Slavery, let us obtain a view of the principles, by virtue of which law arises out of those constitutions and compacts, by which people agree to establish government. To do this it is necessary to define the term law.
In all these some concessions to the liberal principles of intercourse proposed by the United States had been obtained; but as in all the negotiations they came occasionally in collision with previous internal regulations or exclusive and excluding compacts of monopoly with which the other parties had been trammeled, the advances made in them toward the freedom of trade were partial and imperfect.
When the fugitives from the field of battle reached Choo Hoo, he could at first scarce restrain his indignation, for he had deemed the treaty in full force; he exclaimed against the perfidy of a Power which called itself civilised and reproached his host as barbarians, yet thus violated its solemn compacts.
While, therefore, in general, the people of the Northern States have never at any time arrogated for the Federal Government the power to interfere directly with the domestic condition of persons in the Southern States, but, on the contrary, have disavowed all such intentions and have shrunk from conspicuous affiliation with those few who pursue their fanatical objects avowedly through the contemplated means of revolutionary change of the Government and with acceptance of the necessary consequences a civil and servile war yet many citizens have suffered themselves to be drawn into one evanescent political issue of agitation after another, appertaining to the same set of opinions, and which subsided as rapidly as they arose when it came to be seen, as it uniformly did, that they were incompatible with the compacts of the Constitution and the existence of the Union.
The allies were welcomed by the secondary German princes, who, in return for compacts guaranteeing their sovereignty, promised to raise contingents that amounted in all to upwards of a quarter of a million of men. Bernadotte marched against the Danes and cut off Davoust in Hamburg, where that Marshal bravely held out to the end of the war.
It would be impossible for individuals to make contracts at all, if it were necessary for them to enumerate all the "self-evident truths," that might have a bearing upon their construction before a judicial tribunal. All such truths are therefore taken for granted. And it is the same in all compacts of government, unless particular truths are plainly denied.
Again, as to compacts, had the Africans ever been parties to these? It was rather curious also, when King James the Second gave a charter to the slave-traders, that he should have given them a right to all the south of Africa, and authority over every person born therein! But, by doing this, it was clear, that he gave them a right which he never possessed himself.
I have never seen a garden in the autumn before, without the uncouth cabbage in it; but my garden gives the impression of a garden without a head. The cabbage is the rose of Holland. I admire the force by which it compacts its crisp leaves into a solid head. The secret of it would be priceless to the world. We should see less expansive foreheads with nothing within.
