Each tract granted, was considered as a military fief, for which the possessor was to appear in arms, and take the field, when required for the public defence. The grants were in tail male; and, on the termination of the estate, the lands were to revert to the trust, to be re-granted to such persons as would most benefit the colony.

The tenements were made descendible to the heirs of the occupiers or copyholders, that is, to their children on the plantations; for no part of the succession was to go out of the plantations to the issue of any foreign wife, and, in case of no such heir, they were to fall in to the lord to be re-granted according to his discretion. "Thus," says Mr.

Thus re-granted, the seigneur could not eject the habitant, but was allowed to receive a nominal or feudal rent from the vassal, and the usual droits. These droits are, first, the barbarous "lods et ventes," or one thirteenth of the money upon every transfer which the habitant makes by sale only; but the original rent can never be raised, whatever value the land may have attained.

The land was BENEFICIA, just as appointments in the Church, and reverted, as they do, to the patron to be re-granted. They were held upon military service, and the major barons, adopting the Saxon title Earl, claimed to be PEERS of the monarch, and were called to the councils of the state as barons-by-tenure.

The titles of the natives were ruthlessly forfeited, the six counties of the province of Ulster were re-divided, and the land was re-granted to proprietors who engaged to settle colonists from England and Scotland upon it according to a fixed system. This system was skilfully devised and rigidly carried out.

Dom Diniz therefore determined not to exterminate the Templars, but to change them into a new military order, so in 1319 he obtained a bull from John XXII. from Avignon constituting the Order of Christ. At first their headquarters were at Castro-Marim at the mouth of the Guadiana, but soon they returned to their old Templar stronghold at Thomar and were re-granted most of their old possessions.
