Foreseeing the probable reliance of the British Government on the provisions of the Clayton-Bulwer treaty of 1850 as affording room for a share in the guaranties which the United States covenanted with Colombia four years before, I have not hesitated to supplement the action of my predecessor by proposing to Her Majesty's Government the modification of that instrument and the abrogation of such clauses thereof as do not comport with the obligations of the United States toward Colombia or with the vital needs of the two friendly parties to the compact.

The Clayton-Bulwer treaty was negotiated with the expectation that the construction of a ship canal would rapidly follow, but the unfortunate entanglements that grew out of the variant constructions put upon that treaty by the contracting powers deferred to an indefinite period the accomplishment of the object it was designed to promote.

Since the signature of the Clayton-Bulwer Treaty, this "settlement," as it was styled in that instrument, has become a British "possession," by a convention with Guatemala contracted in 1859. Later, in 1862, the quondam "settlement" and recent "possession" was erected, by royal commission, into a full colony, subordinate to the government of Jamaica.

Settling the Alaskan boundary favorably to the United States at every point save one, crumbling with the single stroke of his Pauncefote treaty that Clayton-Bulwer rock on which Evarts, Blaine, and Frelinghuysen in turn had tried dynamite in vain, were deeds seldom matched in statecraft.

The United States Senate, however, amended the treaty in three important particulars: by declaring that the Clayton-Bulwer treaty was thereby superseded; by providing that the restrictions in the regulations governing the use of the canal should not apply to measures which the United States might adopt for its own defense and for the maintenance of public order along the canal; and by cutting out entirely the article providing for the adherence of other powers.
