The commons seemed to vie with the lords in their zeal for the government. They brought in a bill for attainting the pretended prince of Wales, which being sent up to the other house, passed with an additional clause of attainder against the queen, who acted as regent for the pretender. This however was not carried without great opposition in the house of lords.
The Commons examined the couriers who had arrived from the West, and instantly ordered a bill to be brought in for attainting Monmouth of high treason. Addresses were voted assuring the King that both his peers and his people were determined to stand by him with life and fortune against all his enemies.
The house, however, having taken the letters into consideration, resolved to draw up an address to the king, desiring him to secure and disarm all papists of note; and they brought in a bill for attainting several persons in rebellion against their majesties; but it was not finished during this session.
The commons passed a bill, appointing him to surrender himself before a certain day, or, in default of it, attainting him. He reminded the Lords Triers, in very significant language, that Delamere had, in Parliament, objected to the bill for attainting Monmouth, a fact which was not, and could not be, in evidence. But it was not in the power of Jeffreys to overawe a synod of peers as he had been in the habit of overawing common juries.
But the most acceptable part of parliamentary proceedings was the granting of subsidies; the attainting and punishing of the obnoxious nobility, or any minister of state after his fall; the countenancing of such great efforts of power, as might be deemed somewhat exceptionable, when they proceeded entirely from the sovereign.
