The commons having carried their point, which was to stigmatize those noblemen and prevent their being employed for the future, suffered the impeachments to be neglected until they themselves moved for trial. On the fifth day of May the house of lords sent a message to the commons, importing, That no articles had as yet been exhibited against the noblemen whom they had impeached.

William foreseeing nothing but opposition from the present spirit of the house of commons, closeted some of their leaders with a view to bespeak their compliance; but finding them determined to pursue their former principles, and to insist upon their impeachments, he resolved, with the advice of his friends, to dissolve the parliament.

The governors dissolved the legislatures with a frequency unparalleled in political history, and were personally drawn into the conflict. Such a tribunal was long maintained in New York, of which the senators formed the majority, but in which the chancellor and judges of the Supreme Court also sat. In most States the Senate alone constitutes the court for trying impeachments, but should the Governor be thus brought before them, the Chief Justice is added to it, and presides.

The 32d paragraph orders, “That a court shall be instituted for the trial of impeachments and the correction of errors under the regulations which shall be established by the legislature, and to consist of the president of the senate for the time being, and the senators, chancellors and judges of the supreme court.”

He closed his parting message by predicting that after he had been long laid in the grave, the impeachments against his character would be, at last, although too late, retracted. So spake the unhappy envoy, and his friend replied with words of consolation.

And those who oppose this part of the federal plan, act in direct opposition to what the anti-federalists often profess, for the excellency of our constitution has been their favourite theme. The third section also provides, that the senate shall have the sole power to try all impeachments. This clause seems to be peculiarly obnoxious to anti-federal sycophants.
