A few years afterwards the consul of 640 Gaius Porcius Cato was surprised in the Servian mountains by the same Scordisci, and his army completely destroyed, while he himself with a few attendants disgracefully fled; with difficulty the praetor Marcus Didius protected the Roman frontier.

Having entered when all was still, they were severally conducted into their tents by the men of their own description, where they were hospitably entertained with the utmost joy on the part of all. The next day a council was held, at which Lucius Porcius Licinus, the praetor, was present.

Then was held the election of praetors. The persons chosen were, Lucius Cornelius Merula, Marcus Claudius Marcellus, Marcus Porcius Cato, and Caius Helvius, who had been plebeian aediles. By these the plebeian games were repeated, and, on occasion of the games, a feast of Jupiter was celebrated.

The conversation is supposed to take place between Cato, Scipio Africanus the younger, and Laelius, in the year before Cato's death, i.e. 150 B.C., when he was in his eighty-fourth year, Scipio being about 35 and Laelius a few years older. The praetors then cast lots for their provinces: to Caius Fabricius Luscinus fell the city jurisdiction; Caius Atinius Labeo obtained the foreign; Cneius Manlius Vulso, Sicily; Appius Claudius Nero, Farther Spain; Publius Porcius Laeca, Pisa, in order that he might be at the back of the Ligurians; and Publius Manlius was sent into Hither Spain, as an assistant to the consul.

The benches, the tables, the platform from which the orators spoke, the wooden tablets on which the clerks wrote their notes, were collected to make a funeral pile on which the corpse was to be consumed. The hall caught fire, and was burned to the ground; another large building adjoining it, the Hall of Porcius, narrowly escaped the same fate.

The Italian allies, who were attached to the legion, seem to have been similarly armed and equipped, but their numerical proportion of cavalry was much larger. Nero commanded the right wing, Livius the left, and the praetor Porcius had the command of the centre.
