Sobald irgend ein Punkt des Programms nicht genau eingehalten werden sollte, wird 10 Proz. der gestellten Kaution zurückbehalten. Die Wrights hatten 2500 Dollar Kaution zu stellen. Im Mai 1908 begaben sich nun die beiden Brüder in ihre alte Einöde zu Kill Devil bei Kitty Hawk, wo sie, weit entfernt von den wenig Anerkennung zeigenden Mitbürgern ihrer Heimatstadt, ungestört arbeiten konnten.
Dezember 1903 wurden an einem kalten und windigen Tage zu Kill Devil bei Kitty Hawk in Gegenwart von nur 5 Personen die ersten Flugversuche mit dem Motorflieger unternommen. Dieser Tag ist demnach als Geburtstag der ersten freifliegenden mit eigener Kraft vorwärts getriebenen Flugmaschine anzusehen.
