The Protestant war-chiefs, D'Alton M'Carthy, Colonel O'Brien, and John Charlton, took up the tomahawk, and called on the Dominion Government to disallow the act. But Sir John Macdonald declined to intervene. A resolution in the House of Commons calling for disallowance was defeated by 188 to 13, the minority being chiefly Conservatives from Ontario.
The incident directed attention to the previous practice at Ottawa under both parties and a new era of non-intervention was inaugurated. Disallowance is now rare, except where Imperial interests are affected, and never occurs on the ground of the policy or impolicy of the measure. The provinces, as a matter of practice, are free within their limits to legislate as they please.
The burgesses had developed their constitutional positions during the 1750's in response to a series of minor, isolated events royal disallowance, the Pistole Fee Controversy, and the Two-Penny Act. After trying for years to codify and reform laws long in use, the General Assembly in 1748 completed a general revision of the laws.
